Summary

Application of art. 8 of Law 83-634 and 4 of Decree 48-1108.
This Order repeals and supersedes Order 72-732, however, in the state, including provisions relating to personnel belonging to the bodies of the deck and pavement engineers and occupying functional jobs as Regional Equipment Director and Departmental Equipment Director.
Secondly, this legislation regulates, by giving it a regulatory scope, the compensation scheme for civil administrators, architects and planners and senior administrative staff of the decentralized services occupying the functional jobs of the Regional Equipment Director and departmental equipment director. The maximum of this allowance is increased from 54% of the agent's salary to 60% of the highest employment index.
Finally, this text implements one of the decisions of the inter-ministerial meeting of 13-12-2001 on new indiciary enhancement (NBI). Indeed, it had been decided to exclude from the benefit of the NBI the agents belonging to the body of the engineers of the bridges and pavements occupying the functions but not detached in the functional jobs of director; Assistant Chief of Service or Deputy Director of Central Administration. But the record of this interdepartmental meeting left the department's care to implement an allowance to compensate for the absence of NBI for these non-supplied officers in functional employment.

The Prime Minister,
On the report of the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, and in particular article 20 thereof, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 48-1108 of 10 July 1948, establishing hierarchical classification of the ranks and jobs of civil and military personnel of the State under the general pension system, including article 4;
Having regard to amended Decree No. 70-912 of 5 October 1970 on the conditions of appointment and advancement in the jobs of departmental director and regional manager of equipment;
In light of amended Decree No. 72-18 of 5 January 1972 on service and performance allowances for officials of the technical bodies of the Ministry of Equipment and Housing,

Officials employed as Regional Service Chiefs or Departmental Director may be eligible for a service and performance premium, the rate of which is determined by a joint order of the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management.

Deck and pavement engineers in the position of Chief of Central Administration Service, Deputy Director of Central Administration or Deputy Director of Central Administration may be eligible for a service and performance award, the rate of which is determined by a joint order of the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Economy, Finance and Industry and the Minister of State Management,

The premiums set out in Articles 1 and 2 of this Order are allocated according to the importance of the position and the quality of the services rendered.

Agents belonging to the civil administrators, architects and planners of the State and senior administrative staff of the decented services occupying a job as regional chief of service or departmental director receive, as exclusive of any other compensation regime, the premium provided for in Article 1 of this decree.

Agents of the deck and pavement engineers, acting as the head of central administration, deputy head of central administration or deputy head of central administration, shall, as exclusive of the service and performance award provided for in the aforementioned decree of January 5, 1972, receive the service and performance award established by this decree.

Order in Council No. 72-732 of 2 August 1972 on service and performance premiums allocated to employees occupying positions of regional service chief or departmental equipment director is repealed.

This Order is applicable effective 1 January 2003.

The Minister of Economy, Finance and Industry, the Minister of Equipment, Transport, Housing, Tourism and the Sea, the Minister of Public Service, State Reform and Land Management, and the Minister Delegate for Budget and Budget Reform are responsible for the execution of this Order, each of which will be published in the Official Journal of the French Republic.
