Order of 18 September 2006 amending the order of 7 January 2003 relating to the general requirements for classified facilities subject to declaration under heading 1434: flammable liquids (fill or distribution facility)

Minister of Ecology and Sustainable Development,
Considering Directive No. 94/63/EC of 20 December 1994 on combating emissions of volatile organic compounds (VOCs) resulting from the storage of gasoline and its distribution of terminals to service stations;
Considering Directive No. 99/13/EC of 11 March 1999 on the reduction of emissions of volatile organic compounds due to the use of organic solvents in certain activities and facilities;
Considering the environmental code, including article L. 512-10;
Considering Decree No. 77-1133 of 21 September 1977 as amended for the application of Act No. 76-663 of 19 July 1976 on facilities classified for the protection of the environment;
In view of Decree No. 92-158 of 20 February 1992 supplementing the Labour Code and fixing the special hygiene and safety requirements applicable to work carried out in an establishment by an outside company;
In view of Decree No. 96-1010 of 19 November 1996 on devices and protection systems for use in explosive atmospheres;
In view of Decree No. 2001-349 of 18 April 2001 on the reduction of emissions of volatile organic compounds related to the supply of vehicles in service stations;
Considering the decision of 23 January 1980 on the precautions to be taken for fuelling aircraft on airfields;
Considering the March 31, 1980 Decision on the Regulation of Electrical Facilities of Regulated Establishments under the ICPE legislation and which may present explosion risks;
Considering the Order of 8 December 1995 on the Control of Volatile Organic Compound Emissions resulting from the storage of gasoline and its distribution of terminals to service stations;
Having regard to the decision of 22 June 1998 on buried tanks of flammable liquids and their associated equipment;
In view of the decision of 10 October 2000 setting out the periodicity, purpose and extent of checks of electrical installations for the protection of workers and the content of the reports relating to such checks;
Considering the amended decision of 17 May 2001 on the reduction of emissions of volatile organic compounds related to the fuelling of motor vehicles in service stations with a flow rate of between 500 and 3,000 cubic metres per year;
Considering the amended decision of 17 May 2001 on the reduction of emissions of volatile organic compounds related to the gasoline supply of motor vehicles in gasoline stations with a gasoline flow exceeding 3,000 cubic metres per year;
Considering the decision of 7 January 2003 on the general requirements for classified facilities under heading 1434: flammable liquids (filling or distribution installation);
Considering the 14 January 2004 regulation of compressed natural gas installations of motor vehicles;
In light of the opinion of the Higher Council of Facilities classified on 18 October 2005,
Stop it!

Article 1


The title of the above-mentioned decision of 7 January 2003 is replaced by: "Resolution of 7 January 2003 on the general requirements for classified facilities under headings 1434 (inflammable liquid filling or distribution facility) and/or No. 1413 (in the distribution of natural gas or biogas) of the nomenclature of classified facilities".

Article 2


Section 1 of 7 January 2003 referred to above is replaced by the following provisions:
"Scheduled facilities subject to reporting under at least one of sections 1434 and 1413 are subject to the provisions of Schedule I (1). These provisions apply without prejudice to other legislation. »

Article 3


Annexes I to V to the above-mentioned decision of 7 January 2003 are replaced by annexes I to V to this Order.

Article 4


The provisions of Annex I shall apply within six months of the publication of this Order in the Official Gazette for facilities reported after that date.

Article 5


The Director of Pollution Prevention and Risk is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
