Judgment of 2 October 2007 setting out the terms of the tests for access to the preparatory cycle for the internal competitive examination for hospital staff

In light of the amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with Act No. 86-33 of 9 January 1986 on statutory provisions relating to the public hospital service;
In view of Decree No. 2001-1207 of 19 December 2001 as amended by Decree No. 2007-1187 of 3 August 2007, establishing the special status of the body of hospital staff and amending Decree No. 90-839 of 21 September 1990 establishing the special statutes of administrative staff of the modified public hospital service;
In light of Decree No. 2007-704 of 4 May 2007 on the organization and operation of the National Centre for the Management of Hospital Practitioners and Management Personnel of the Hospital Public Service and amending the Public Health Code,

The competition for access to the preparatory cycle provided for in section 7 of the above-mentioned decree of 19 December 2001 is open by order of the Minister for Health and announced at least two months in advance by publication in the Official Journal of the French Republic.
25% of the competitive positions are offered under the first category of candidates defined in the sixth paragraph of Article 7 and 75% under the second category.
The opening order of the contest sets the date of the tests and the centres where they will take place. After the registration is closed, written test centres may be deleted or added to reflect the geographical distribution of candidates.

Tests for access to the preparatory cycle include:
A. - Written and anonymous proof of eligibility:
Drafting a summary note on a general topic (duration: three hours); coefficient 3).
This is common to both categories.
B. - Oral admission test:
A conversation with jury members (duration: 30 minutes); coefficient 3), as follows:
- on the one hand, presentation of the candidate's career path and motivations, as well as a presentation to the candidate's choice, of a topic or topical topic (maximum duration: fifteen minutes; preparation time: fifteen minutes;
- on the other hand, exchanges with the jury (maximum duration: fifteen minutes).
This test is common to both categories.

It is assigned, for each test, a rating ranging from zero to twenty. Each rating is multiplied by the coefficient set out in Article 2 above. The sum of the products thus obtained forms the total points for all the tests. The written test is corrected by two correctors. One of the correctors, at least, must be a member of the jury. The oral conversation test is noted by the jury as a whole.
Candidates who have obtained a total of points fixed by the jury for the written proof of eligibility and who cannot be less than 30 attend the oral admission test.
Candidates who have obtained a total of points fixed by the jury for all the trials and who cannot be less than 60 can only be declared admitted.

At the end of these trials, the jury shall establish, by order of merit, within the limits of the places offered by the order of the competition, the lists of candidates admitted respectively under the two categories defined in article 1 above.
Places placed in the contest that would not be filled by the nomination of candidates from the corresponding category may be assigned to candidates from the other category.
The jury may draw up one or two additional lists (one per category) with, in order of merit, the names of candidates who may be admitted to the preparatory cycle in the event that vacations resulting from resignations will occur.

The jury is appointed by order of the Minister for Health.
It includes:
- the director of hospitalization and care organization or his representative;
- the Director General of Social Action or his representative;
- the director of the National School of Public Health or his representative;
- a member of the management staff of the institutions referred to in Article 2 (1°, 2° and 3°) of the above-mentioned Act of 9 January 1986, governed either by Decree No. 2005-921 of 2 August 2005, or by Decree No. 2001-1343 of 28 December 2001, designated by the Minister for Health;
- a hospital administration officer, designated by the Minister for Health.
He or she may be appealed if necessary to retired staff.
Correctors may be appointed by order of the Minister for Health to participate with the members of the jury in the correction of the trials. They delibrate with the jury with advisory voice for the award of notes to the tests they corrected.
The jury is chaired by the Director of Hospitalization and Care Organization. In the event of absence or incapacity, the President is appointed by the Minister responsible for health.
The secretariat is provided by an officer of the National Hospital Practitioners and Management Centre of the Hospital Public Service.

The Director General of the National Centre for the Management of Hospital Practitioners and Management Personnel of the Hospital Public Service determines the list of candidates authorized to compete.

The preparatory cycle is organized by the National School of Public Health.

Applications for examinations must be submitted, by registered fold, to the National Centre for the Management of Hospital Practitioners and Management Personnel of the Hospital Public Service, building Le Ponant, 21, rue Leblanc, 75015 Paris, prior to the registration closing date.
An order sets the opening date of the contest.
These files include:
A. - For all candidates:
1° An application based on a print provided to the candidate, including the centre chosen for the written test; the application is subject to the supervisor who certifies that the candidate is in office;
2° A statement of completed, printed services provided to the candidate by the National Hospital Practitioners and Hospitallers Management Centre, which will be completed by the appointing authority.
Records, duly completed, must be sent, by registered fold with acknowledgement of receipt, to the same address. No file sent (the cachet of the position being authentic) or delivered after the deadline will be accepted.
B. - For candidates declared admitted after the examination:
1° A request to extract a criminal record (bulletin no. 2);
2° A certificate issued by a sworn or approved physician attesting, in accordance with the indications on the printed certificate issued to the candidate, that the candidate is not affected by any disease or disability incompatible with the performance of the hospital administration duties; for candidates with disabilities, a notice by the Commission on the Rights and Autonomy of Persons with Disabilities that the candidate's disability is compatible with the exercise of hospital functions;
3° A notice of information on which will be mentioned, in particular, the preparation centre requested by the candidate;
4° Only candidates received for the examinations completed within the regulatory deadline may be admitted to the preparatory cycle. After this period, it may be appealed, if any, to candidates on the complementary lists established by the jury of the contest, to replace the failed candidates.
To obtain all necessary prints for the preparation of the application for admission to compete, candidates must address, as soon as the competition is announced, the National Centre for the Management of Hospital Practitioners and Management Personnel of the Hospital Public Service, building Le Ponant, 21, rue Leblanc, 75015 Paris.

The supervision of the tests is under the responsibility of officials designated for this purpose.

Any fraud, attempted fraud or violation of the trial regulations shall result in the exclusion of the trial, without prejudice, if any, to the application of the criminal provisions in force.

In the tests, candidates are prohibited:
1° Introduce in the place of the tests any document or note, to make use of any instrument of calculation whatsoever;
2° To communicate with each other or receive any information;
3° Get out of the room without permission.
Applicants must lend themselves to the necessary monitoring and verification.
No immediate sanction is taken in the event of a finding of flagrante delicto; the supervisor prepares a report that he transmits to the jury.

The exclusion of the contest is pronounced by the jury, which may also propose to the Minister responsible for health the temporary or final prohibition of taking part in a subsequent competition. No decision can be made without the individual being summoned and allowed to present his defence.

The Director of Hospitalization and Care Organization is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
