Having regard to the Act of 23 December 1901 punishing fraud in examinations and competitions;
Having regard to Act No. 2002-73 of 17 January 2002 concerning social modernization, and in particular article 69 thereof;
Saw the Ordinance n ° 58 - 1373 of December 31, 1958 the creation of hospital and university centres, to the reform of medical education and the development of medical research;
Mindful of Decree No. 56-585 June 12, 1956 amended establishing the general system of remuneration of agents of the State or staff non-staff providing as an ancillary occupation either an educational task, or the functioning of boards exams or competition;
Having regard to Decree No. 86 - 442 of 14 March 1986 concerning the designation of physicians approved for the Organization of medical committees and commissions of reform, the conditions of fitness for admission to public employment and staff sick leave plans, including article 1 thereof;
Mindful of Decree No. 2002-1210 of 26 September 2002 on the national aptitude tests referred to in the third paragraph I of article 69 of Act No. 2002-73 of 17 January 2002 concerning social modernization;
Considering Decree No. 2002 - 1211 of 26 September 2002 on the functions to access the national aptitude tests as the contractual practitioner for persons not fulfilling the conditions of exercise of the profession of dentist in France referred to in article 69 of the Act No. 2002-73 of 17 January 2002 modernization, stop: provisions General Article 1 in accordance with the provisions of the third paragraph of article 69 of the aforementioned law of January 17, 2002 I the national aptitude tests as the contractual Assistant practitioner are open to people French or foreign, a doctor of dental surgery degree which do not fulfil the conditions required for the exercise of the profession of dentist in France.
To participate in the tests, applicants must complete the duration of function and degree requirements.
The national aptitude tests are organized in the manner provided by this order.
Article 2 the timetable for registration and events date shall be determined by order published in the Official Journal and posted at least eight days before the opening of the inscriptions at the headquarters of the regional directorates of health and Social Affairs in metropolitan France and in the departmental directorates of the health and Social Affairs of overseas departments.
In metropolitan France, registrations are carried out at the headquarters of the regional directorates of health and Social Affairs. In the overseas departments, entries are carried out at the headquarters of the departmental directorates of health and Social Affairs.
Applications are to be filed with the Regional Directorate of welfare and health in metropolitan France or the departmental Directorate of health and social of Overseas Affairs which the hospital establishment where the candidate functions primarily.
No attachment shall be accepted after the closing of entries.
Registration Article 3 registration is provided by the administration. It consists of the following parts: 1 ° an administrative file.
2 ° an application for clearance of the scientific value equivalent to that of the degree allowing the exercise of dental surgery in France.
The administrative record, duly completed and signed by the candidate, must include the following parts:-the legible photocopy of the map of French identity or passport;
-photocopy of the valid residence card;
-the certificate of nationality for nationals of States not belonging to the European Economic Community;
-a copy of the original of the diploma of doctor of dental surgery;
-the copy of the translation of the diploma of doctor of dental surgery when it is drafted in a foreign language, established by a translator sworn french courts;
-the employment contracts or administrative acts stating that the candidate held well at least one of the functions referred to in article 2 of Decree No. 2002-1211 26 September 2002 referred to above, justifying required training time, outside the period of training referred to in article 69 of the law of 17 January 2002 I referred to above;
-a document issued by the competent French authorities certifying that the candidate is located in one of the situations referred to in the fourth paragraph of article 69 of the aforementioned law of January 17, 2002;
-physical and mental fitness certificate prepared by a licensed physician.
The application for certification of the scientific value equivalent to that of the degree allowing the exercise of dental surgery in France must include the following parts:-copy, certified true by a French authority in the original of the diploma of doctor of dental surgery.
-the translation of the diploma by a translator approved by the french courts, if this document is written in a foreign language;
-an attestation by the competent university authorities of the country which has granted diploma specifying that this diploma sanctions in the country to obtain a course of at least four years of education of dental surgery.
This document should reveal details of lessons and courses validated for the duration of their studies, year by year.
Any file does not include the parts mentioned above will be declared inadmissible and the application will be rejected.
Article 4 the technical dossier to the jury is a test. It consists of two parts: part 'titles and works', in which the candidate shall include:-the list of tracks academic and hospital obtained in France and abroad;
-the list of his publications and his work as well as any document he wishes to produce in support of his candidacy.
-copy of diplomas;
A part "services rendered" to assess the medical exercise and hospital of the candidate, in which the candidate shall include the exercise of dental surgery in France and abroad.
Candidates are required to produce supporting documents certifying the information contained in the technical dossier.
All the above-mentioned documents must be written in french or translated by a translator approved by the french courts.
This folder is to be filed in two copies in a closed envelope. This folder will be necessarily attached to the application form under penalty of rejection of application.
Article 5 registration records are to withdraw to the regional or departmental health and social affairs directorates mentioned in section 2 above.
The above services are responsible for control the registration files and to decide on the admissibility of applications.
In addition, they are responsible for transmitting requests for equivalency diploma in the relevant services of the Minister in charge of universities that pronounces on the equivalence of diplomas.
The technical files are forwarded to the members of the jury.
The periods of training devoted to the preparation of the diploma of specialized studies in foreign title, the national certificate of special studies in foreign title or the inter-university diploma of specialization are not taken into account for the calculation of the term of office. Shall be counted and the semesters of training set for obtaining such graduates.
The services listed above have the regional management file of postgraduate students any fraud or fraud attempt to make use of fake parts causes the rejection of nomination, without prejudice, where appropriate, the application of the penal provisions provided for in the above-mentioned December 23, 1901 law punishing fraud in examinations and competitions.
The same measures may be taken against the accomplices of the main author of the fraud or attempted fraud.
The list of candidates allowed to compete is stopped by the Minister in charge of health and published in the official Bulletin of the Ministry of health. It is also displayed at the headquarters of the regional and departmental health and social affairs directorates mentioned above.
Composition and functioning of boards Article 6
A jury consists, respecting the allocation provided for in article 4 of Decree No. 2002-1210 of 26 September 2002 referred to above.
The jury includes four members if the number of candidates is less than or equal to thirty and two members more additional increments of fifty candidates.
The Board members are appointed by order of the Minister responsible for health.
The composition of the Board is displayed at the place of the competition.
Article 7 the Board elects a president by secret ballot. If the president is unable to serve, this function is performed by the oldest Member.
The Board may meet only if at least half of the members are present.
Article 8 the president of the Board provides general police of the tests.
He attended the written tests. In the case of impediment, it means the Member of the jury who, under his responsibility, replaces it in its functions. The Chairman of the Board has the authority to exclude any candidate from the examination room which cause disorders during the course of the written tests.
In the event of fraud or attempted fraud in the written tests, the Chairperson of the Board informs the candidate of possible exclusion from these tests, after views of all of the members of the jury.
Article 9 the president of the Board proceeded to the distribution of double correction tasks of written tests as well as the dual evaluation of the dossiers 'titles and works' and 'services rendered'.
All the Board members perform the functions checker and rapporteur of the technical records.
Article 10 for each anonymous written examination, the Board proposes at least two subjects comply with articles 16 and 17 below.
President of the jury presents the subjects validated by all members, the Administrative Manager, which ensures privacy and reproduction.
Article 11 the Board establishes a grid of correction for the written tests and a scoring grid for the review of the technical records, ensuring equal conditions of candidates rating.
The topics to be taken into account for the preparation of the evaluation of the technical records grid are those set out in article 18 of this order.
The grids are validated by all the Board members. In case of disagreement of one Member, the grid is adopted by a majority vote in a round vote. The votes are recorded in the minutes.
Article 12 each anonymous practical knowledge test are subject of a double correction.
The Chairman of the Board must provide a statement of the marks assigned by each corrector to the Administrative Manager. After the delivery of the notes to the administration, they will no longer be modified. The final score, corresponding to the arithmetic mean of the two notes, is calculated by the administration.
The lifting of the anonymity of the written tests is carried out by the administration.
The administrative manager shall provide notes of the events written to the Chairman of each Board at the time of the plenary deliberation.
Provisions relating to tests Article 13 the national aptitude tests in the third paragraph I of article 69 of the aforementioned law of January 17, 2002 are as follows:-an anonymous written test of theoretical knowledge listed on 60 points.
-an anonymous written examination of practical knowledge listed on 120 points;
-a test on file with titles and work assessment and evaluation of the services listed on 40 points.
Article 14 the anonymous tests of theoretical and practical knowledge are organized by the prefect of the responsible of the Organization of the events and, by delegation, by the regional director of health and Social Affairs which means an administrative official, doctor Inspector of public health, to assist the jury.
The tests are organized in Orléans.
The material organization of the events, the convening of the candidates, corrections and the seizure of the anonymous results are provided by the regional director of health and Social Affairs concerned.
Anonymity is guaranteed through a grid of computerized concordance.
At the end of the correction of anonymous tests of theoretical and practical knowledge, the lifting of anonymity is made using a computerized procedure. These tests scores are given to the Chairman of each Board at the time of the plenary deliberation.
Article 15 each anonymous event is the subject of a double correction. The criteria of correction must be approved by all of the members of the jury. Weighting can be done by the Board at the end of corrections operations.
Article 16 the anonymous test of theoretical knowledge has several parts each comprising a statement, possibly accompanied by traces of iconographical data, followed by one or several questions calling editorial responses. The following breakdown is applied: test of Pathology, of a duration of 2 hours, denoted from 0 to 20, coefficient 3.
Candidates make up for each event on one of the proposed subjects randomly drawn before the start of the written tests.
Any score below 6 is eliminatory.
Article 17 the anonymous test of practical knowledge has multiple parts each containing a statement, possibly accompanied by traces of iconographical data, followed by one or several questions calling editorial responses. The following breakdown is applied: 1 ° to stand in front of an emergency and/or conduct practical face one or more problems diagnosed, lasting two hours, marked from 0 to 20, coefficient 3.
2 ° approach diagnostic and/or therapeutic, lasting two hours, rated from 0 to 20, coefficient 3.
Candidates make up for each event on one of the proposed subjects randomly drawn before the start of the written tests.
Any score below 6 is eliminatory.
Article 18 'titles and works' files and folders 'services rendered' are given by the administrative authority to the president of the jury.
The folder 'titles and works' is noted on 20 points, as follows:-tracks academic and french hospitals and foreigners (on 16 points);
-publications (on 2 points);
-other (on 2 points).
The folder "services rendered" is noted on 20 points, as follows:-hospital services in France, by function (by 10 points).
-hospital services abroad in a University recognized (on 3 points);
-Hospital guards and participation to the UAS (on 6 points);
-certified (on 1 point) teaching function.
To be noted, the information in the technical dossier must be attested by administrative, hospital authorities or academics as appropriate or justified.
The Board can ask not to see the technical files of candidates who obtained a playoff score to one of the written tests. Each rapporteur proposes a note by folder.
All ratings are adopted by all the members of the jury attended plenary, after hearing each rapporteur.
In case of dispute, the Chairman of the Board proposes a vote by secret ballot. In this case, the notes shall be adopted majority voting. In the event of a second round, the president has two votes. The marks obtained by the candidates as well as the votes of the members of the Board are contained in the minutes.
The jury lists of fitness in alphabetical order. Applicants can be registered on the list of suitable candidates if they have not obtained the average across the notes.
The president of the jury presents minutes of test administration.
Article 19 during the written tests, it is especially forbidden:-to introduce the scene of events any document or note, a mobile phone, any other device to communicate or receive information, any organizer handheld device;
-to communicate between candidates or with the outside world;
-to leave the room without permission of the supervisor of tests.
Applicants must submit to surveillance measures and the necessary checks to the smooth running of events.
Responses to written questions are written in black or blue ink on forms provided for this purpose, to preserve the anonymity of the candidate. Any mention or sign worn by the candidate, amending the document to allow its identification, or non-use of form is voided copy.
The use of the calculator is not allowed.
Article 20 the national aptitude tests as the contractual Assistant practitioner are classified in Group I according to the provisions laid down by the Decree of 12 June 1956 referred to above.
Article 21 the Director of hospitalization and the Organization of the care of the Ministry of health, family and disabled persons and the Director of the higher education of the Ministry of youth, national education and research are responsible, each in relation to the execution of this order, which will be published in the Official Journal of the French Republic.
