Order of September 20, 2002 establishing an automated processing of nominal information regarding the management of the distribution of benefits offered by the "restaurant and accommodation" divisions of the air station and the control and management of access by the airbase security office, units and sites attached to the air force

The Minister of Defence,
Considering the Council of Europe Convention for the Protection of Persons with regard to the automated processing of personal data made in Strasbourg on 28 January 1981, approved by Act No. 82-890 of 19 October 1982, which entered into force on 1 October 1985 and published by Decree No. 85-1203 of 15 November 1985;
Having regard to Act No. 78-17 of 6 January 1978, as amended, relating to computing, files and freedoms, and in particular Article 15 thereof;
In view of the amended Decree No. 78-774 of 17 July 1978 for the application of chapters I to IV and VII of Act No. 78-17 of 6 January 1978 on computers, files and freedoms, including articles 12 and 19;
Having regard to the amended decision of 16 May 2002 bearing delegation of signature;
In view of the letter from the National Commission on Information and Freedoms dated 8 July 2002 bearing number 808963,

Article 1


It is created at the Ministry of Defence, at the Air Force headquarters, an automated processing of nominal information, known as DRL-control and access management, and whose purpose is to manage the distribution of services offered by the "remediation and accommodation" divisions of the Air Commissioner and to control and manage access by the airbase security office, units and sites attached to the air station.

Article 2


The categories of information recorded are those relating to:
I. - For customer management:
- to identity (name, first names, adhering code, badge number, photograph);
- professional life (grade or function, original service, assignment, weapon or status, air incorporation numbers, bail amount);
- to the economic and financial situation (at the crossing [date and hour, balance of the customer account]), summary of consumption, right to the bonus of the social action of the armies).
The nominal information thus recorded shall be retained until the person leaves for information relating to the identity, professional life and the right to the bonus of the social action of the armed forces and three months for information concerning the summation of consumption. Variable information (date and time, balance of the customer account) is subject to an instant update at each checkout. However, in the event of a dispute, the information may be retained until the dispute is resolved.
II. - For access control and management:
- to personnel (name [patronymic, marital or use], name, sex, nationality, date and place of birth, photograph, personal address, registration, grade, function, location, service or assignment, authorization [type, date and validity], weapon, presence and/or absence on site, duration of stay, telephone numbers, agency of origin and visited, identification documents [type, date, date, date and date]
- to visitors (name [patronymic, marital or usage], common name, sex, nationality, date and place of birth, personal address, function or business, weapon, service or assignment, identity documents [type, number, date and place of obtaining], residence map [number, date and place of obtaining], length of stay, time of start and end of visit) ;
- the movement of persons (number of the badge or pass, date of creation and period of validity, colour and authorized traffic areas, person visited, service or assignment of the person visited, date of establishment, authorization number, incidents [type, date, loss, theft or deterioration of the access card]);
- to the identification of vehicles (number of the badge or pass, marks and types, mineralogic number, holder of the access authorization, number of the authorization, authorized parking location, date of establishment, insurance [name, number and termination of police validity]);
- to the warning of visitors (name [patronymic, marital or use], common name, sex, nationality, date and place of birth, function or company, conduct to be held).
The retention period of the registered name information is not more than one year after the expiry date of the access authorization, with the exception of the warning, which is retained until it is lifted.

Article 3


The recipients of the recorded information are, depending on their respective responsibilities and the need to know:
I. - For customer management:
- customers;
- the authorized personnel of the computer service of the air station;
- the personnel responsible for the financial services of the "restaurant and housing" division and their supervisors;
- members of inspection bodies.
II. - For access control and management:
- command of the air bases, units and sites attached to the air force;
- the security office responsible for access control and management;
- the air gendarmerie;
- members of inspection bodies.

Article 4


The right of opposition provided for in section 26 of the Act of 6 January 1978 referred to above cannot be invoked in connection with this treatment.

Article 5


The right of access and rectification provided for in sections 34 et seq. of the above-mentioned Act is exercised for the payment of meals to the Director of the "restaurant and accommodation" division of each airbase and for the control and management of access to the security office of each airbase, units and sites attached to the air force.

Article 6


The commanders of the air bases are responsible, each with respect to it, for the execution of this order, which will be published in the Official Journal of the French Republic.
