Judgment of October 4, 2007 relating to the individual reserve of part of the 2007 harvest claimed in controlled label of origin "Champagne"

Having regard to Council Regulation (EC) No. 1493/1999 of 17 May 1999 concerning the joint organization of the wine market;
Having regard to the amended Act of 12 April 1941 establishing an inter-professional committee of Champagne wine;
Having regard to Decree No. 2007-103 of 25 January 2007 on the organization and operation of the inter-professional committee of Champagne wine;
Considering the decree of July 25, 2007 concerning the modalities of operation of the wine reserve claimed in controlled label of origin « Champagne » ;
In view of the deliberation of the executive office of the Inter-Professional Committee on Champagne Wine of 24 July 2007,
Stop:

Article 1


The provisions of the decision V.2.2007 taken by the interprofessional committee of the Champagne wine, on July 24, 2007, relating to the individual reservation of a part of the 2007 harvest claimed in controlled label of origin " Champagne", which is annexed to the present decree in accordance with article 41 of the regulation (EC) n° 1493/1999 referred to above, are approved and made mandatory for the recolants, cooperatives and

Article 2


The Director General of Economic, European and International Policy, the Director General of Competition, Consumption and Suppression of Frauds and the Director General of Customs and Indirect Rights are responsible, each with respect to him, for the execution of this Order, which will be published in the Official Journal of the French Republic.

The Interprofessional Committee of Champagne Wine,
Having regard to the amended Act of 12 April 1941 establishing the Interprofessional Committee of Champagne Wine;
Having regard to Decree No. 2007-103 of 25 January 2007 on the organization and operation of the inter-professional committee of Champagne wine;
Considering Decision No. 169 of 13 June 2007 on the individual reservation of wines claimed in controlled label of origin “Champagne”;
In view of the deliberation of the Executive Office of 24 July 2007,
Decides:


Article 1
Amounts available


Are subject to a measure of reserve all the grapes of the harvest 2007, claimed in controlled label of origin “Champagne”, which are harvested beyond the yield of 12,400 kilograms of grapes to the hectare and within the limit, on the one hand, of the maximum yield of 15,500 kilograms of grapes to the hectare authorized for the controlled label of origin “Champagne” and, on the other hand, of the ceiling of the 169

Method of implementation


The modalities for the implementation of this decision are set out in a circular.


Article 3
Penalties for failure


In the event of a breach of the mandatory provisions of this decision, the penalties provided for by the law of 12 April 1941 referred to above may be applied to any offender.
