On the report of the Minister of Public Service and the Minister of Economy, Finance and Industry,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, and in particular article 20 thereof, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 48-1108 of 10 July 1948, establishing hierarchical classification of the ranks and jobs of civil and military personnel of the State under the general pension system;
In view of the amended Decree No. 85-986 of 16 September 1985 on the particular regime of certain positions of State officials and certain modalities for the final termination of functions;
In light of the amended Decree No. 89-259 of 24 April 1989 on the special installation grant awarded to certain beginners,
Decrete:
The first paragraph of Article 2 of the above-mentioned Decree of 24 April 1989 is replaced by the following provisions:
"The special installation bonus may be awarded, under the same conditions as section 1:
- personnel who are once again accessing a body of civil servants of the State after having previously been employed in the public service of the State, territorial or hospital and resigned from that job;
- staff reinstated after a period of separation from the service motivated by a layoff granted in a case other than one provided for in section 47 of the above-mentioned decree of 16 September 1985.
In these two situations, the right to the premium is open provided that the benefit has not been received previously or, if it has been received, that they have reimbursed the amount. »
The Minister of Economy, Finance and Industry, the Minister of Public Service and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
