Summary


Implementation of Decree 2000-815 of 25 August 2000, in particular Articles 3 and 8.This Decree on Equivalency Hours and Derogations from the minimum guarantees of working and rest periods applicable to the employment of drivers of the motor service of the central administration of the Ministry of Sports provides in its article a time of presence of 1800 hours per year. This duration is equivalent to an effective annual working time of 1600 hours. Article 2 of the decree further states that the minimum daily rest is set at 9 hours, by derogation from the minimum guarantees mentioned in Article 3 of the decree of 25 August 2000, which provides for a minimum rest of 11 hours. The driving time of a vehicle was set in the same article at a maximum of 8 hours. In return for their particular work hardships involving, inter alia, a daily amplitude of significant presence, the persons concerned receive compensatory rest integrated in their work cycle (Article 3).

The Prime Minister,
On the report of the Minister of Sport, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
In view of Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time in the public service of the State, including Articles 3 and 8;
Considering the advice of the Departmental Joint Technical Committee on Youth and Sports dated 19 March 2003;
Having regard to the opinion of the Supreme Council of the Public Service of the State of 22 April 2003;
The State Council (Finance Section) heard,

The time for the presence of the drivers of the car service of the department of sports is 1,800 hours per year.
This is equivalent to an effective annual working time of 1,600 hours.

For the organization of the work of the agents mentioned in Article 1 and by derogation from the minimum guarantees defined in Article 3 of the above-mentioned Decree of 25 August 2000, the minimum daily rest is fixed at 9 hours. During a working day, the driving time of vehicles cannot exceed 8 hours.

The officers referred to in Article 1 shall, in return for their stipulations of duties, receive compensatory rest integrated in their work cycle.

The Minister of Finance and Industry, the Minister of Public Service, State Reform and Land Use Planning, the Minister of Sports and the Minister for Budget and Budget Reform are responsible, each with respect to him, for the execution of this decree, which is published in the Official Journal of the French Republic.
