Summary


Order in Council 71-159 of 26 February 1971 establishes a compensation scheme consisting of a special fixed compensation allowance for special hardships (IFSSP) on the one hand and a performance award on the other hand for the benefit of price investigators. This scheme is exclusive of any special allowance for the grade actually held by each individual. The latter provision is a brake on the performance of the duties of a price investigator by officials involved in a pre-specialized training course on the one hand and subsequently forced to travel frequently in the performance of their duties on the other. In fact, the loss of the indenmity allocated under their bodies of belonging leads them to decline the job offers of a price investigator which constitutes one of the keys to the policy of controlling the costs of the materials of the Ministry of Defence. It is therefore proposed to remove this obstacle by amending the provisions of Article 3 of the above-mentioned decree to remove the cumulative prohibition of IFSSP and an allowance for the membership. However, the benefit of the return premium is provided to apply the most favourable plan when there is a performance bonus device for the membership body. The Prime Minister,
On the report of the Minister of Defence, the Minister of Economy, Finance and Industry and the Minister of Public Service, State Reform and Land Management,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1994 on statutory provisions relating to the public service of the State;
In view of Decree No. 71-159 of 26 February 1971 concerning the regime of compensation of price investigators of the State Ministry for National Defence,
Decrete:

The provisions of Article 3 of the aforementioned Decree of 26 February 1971 are replaced by the following provisions:
“Art. 3. - The performance in accordance with Article 1 of this Order is exclusive of any other performance bonus for the grade actually held by each price investigator. Price investigators eligible for a higher rate of return than the one provided for in previous sections 1 and 2 may opt for the maintenance of this regime. »
