Summary

In-house guards are now recognized in their service obligations when they are imposed on medical continuity, but the time spent on security rest, which is mandatory at the end of each night shift, is not included in service obligations; It is the subject of Article 1 of this Order, which also specifies the terms and conditions under which university half-days may be accumulated. Pursuant to the new provisions on paternity leave, Article 3 of the decree gives the internals a paternity leave of 11 consecutive days during which they receive the remuneration provided for in 1° and 2° of art. 10 of Decree 99-930 of 10-11-1999. Finally, the intern on sick leave will now be entitled, during the first three months of this leave, to the full remuneration provided for in art. 10 (1°, 2°), while until now he had the right only to 2/3 of that remuneration; This is the subject of Article 4 of this Decree. The Prime Minister,
On the report of the Minister of Social Affairs, Labour and Solidarity, the Minister of Youth, National Education and Research, the Minister of Economy, Finance and Industry and the Minister of Health, Family and Persons with Disabilities,
Considering the education code, including articles L. 632-1 to L. 632-12;
Considering the public health code, including article L. 6153-1;
In view of Decree No. 99-930 of 10 November 1999 establishing the status of internals and residents of medicine, pharmacy and internals in odontology, as amended by Decree No. 2001-23 of 9 January 2001;
Having regard to the advice of the Higher Council of Hospitals of 15 January 2002;
The State Council (Social Section) heard,
Decrete:

Article 2 of the above-mentioned Decree of 10 November 1999 is amended as follows:
I. - The second preambular paragraph is replaced by the following:
"His duties of service are set at eleven half-days per week, two of which are devoted to university education that can be grouped according to the needs of the teaching followed and accumulated within twelve days of a semester. »
II. - The third paragraph is replaced by the following:
"The internee participates in the service of guards and guards. Internal guards for the normal custody service are recorded in their service obligations for two-half days for one guard. It may also provide greater participation in the normal custody service. The intern enjoys a safety rest after each night guard. The time spent on security rest cannot result in the fulfilment of hospital or academic service obligations. The terms and conditions of application of this paragraph shall be determined by order of Ministers responsible for health, budget and higher education. »

Article 13 of the above-mentioned Decree of 10 November 1999 is amended as follows:
I. The first sentence of the first paragraph is as follows:
"The intern has maternity, adoption or paternity leave for a period of time. »

II. - The first sentence of the second paragraph is as follows:
"If, upon expiry of maternity, adoption or paternity leave, the intern. »

In the first paragraph of Article 14 of the above-mentioned Decree of 10 November 1999, the words "two thirds" are deleted.
