Decree No. 2005-1141 of 8 September 2005 amending Decree No. 92-904 of 2 September 1992 establishing the conditions of access and the modalities of organizing the competitions for the recruitment of qualified territorial agents of heritage

The Prime Minister,
On the report of the Minister of State, Minister of Interior and Land Management,
Having regard to Act No. 84-53 of 26 January 1984 as amended with statutory provisions relating to the territorial public service;
In light of the amended Decree No. 85-1229 of 20 November 1985 on the general conditions of recruitment of officers of the territorial public service;
In view of Decree No. 91-853 of 2 September 1991 on the special status of the employment framework of qualified territorial agents of heritage, including Article 4 of the Decree;
Having regard to Decree No. 92-904 of 2 September 1992 establishing the conditions of access and the modalities for organizing competitions for the recruitment of qualified territorial agents of heritage;
The Superior Council of the Territorial Civil Service heard,

Article 1 of the above-mentioned decree of 2 September 1992 is replaced by the following provisions:
"Art. 1st. - The external, internal competitions and the third access competition to the framework of employment of qualified territorial agents of heritage include noticeable eligibility and admission tests from 0 to 20. Any rating less than 5 out of 20 is eliminated.


1° External Competition
A. - Written proof of eligibility


They cover:
1. The resolution of a practical case based on the data provided to the candidate on a situation to which a qualified territorial agent of heritage may be confronted in the exercise of his or her functions (duration: two hours; coefficient 4);
2. A questionnaire calling for brief responses on the following areas related to the operation of services in which a qualified territorial agent of heritage may be required to serve:
- reception of the public;
- animation ;
- security of people and buildings.
Duration: one hour; coefficient 2.


B. - Intake test


An interview with the jury from a general text drawn by lot, so as to allow to appreciate the qualities of reflection and the knowledge of the candidate, including the way he envisages his profession (preparation: fifteen minutes; duration: fifteen minutes; coefficient 4).


C. - Optional test


Candidates may request an optional intake or language test, or automated information processing. They express this choice at the time of registration to the contest by specifying the test they wish to undergo.
Only points above average are considered for admission. The program of these trials is set by order of the Minister responsible for local authorities.
The language test is a written test, to be chosen from the following languages: German, English, Spanish, Italian, Portuguese, Modern Greek, Dutch, Russian or Modern Arabic (duration: one hour; coefficient 1).
The automated information processing test is an oral test (duration: 20 minutes, with preparation of the same duration); coefficient 1).


2° Internal competition
A. - Written proof of eligibility


The resolution of a practical case based on the data provided to the candidate on a situation to which a qualified territorial agent of heritage may be confronted in the exercise of his or her functions.
Duration: two hours; coefficient 4.


B. - Intake test


An oral comment from a brief file submitted to the candidate, after a previously specified choice when he was enrolled in the contest, and bearing:
- either on issues of security and public reception, communication and animation;
- either on the presentation of a guided tour of a historical monument or a museum;
- either questions relating to classification and classification in libraries;
- either on issues related to the conservation of written heritage.
Preparation: 30 minutes; duration: 30 minutes; coefficient 3.


C. - Optional test


Candidates may request an optional intake or language test, or automated information processing. They express this choice at the time of registration to the contest by specifying the test they wish to undergo.
Only points above average are considered for admission. The program of these trials is set by order of the Minister responsible for local authorities.
The language test is a written test, to be chosen from the following languages: German, English, Spanish, Italian, Portuguese, Modern Greek, Dutch, Russian or Modern Arabic (duration: one hour; coefficient 1).

Third competition
A. - Eligibility tests


They cover:
1. The resolution of a practical case based on the data provided to the candidate on a situation to which a qualified territorial agent of heritage may be confronted in the exercise of his or her functions.
Duration: two hours; coefficient 4;
2. A questionnaire calling for brief responses on the following areas related to the operation of services in which a qualified territorial agent of heritage may be required to serve:
- reception of the public;
- animation ;
- security of people and buildings.
Duration: one hour; coefficient 2.


B. - Intake test


The admission test for the third competition includes an interview with the starting point of a presentation by the candidate on his or her experience to assess the candidate's analytical and reflection qualities as well as his or her motivation to carry out the job assignments (duration: twenty minutes, of which five minutes are at the most); coefficient 4).


C. - Optional test


Candidates may request an optional intake or language test, or automated information processing. They express this choice at the time of registration to the contest by specifying the test they wish to undergo.
Only points above average are considered for admission. The program of these tests is set as necessary by order of the Minister responsible for local authorities.
The language test is a written test, to be chosen from the following languages: German, English, Spanish, Italian, Portuguese, Modern Greek, Dutch, Russian or Modern Arabic (duration: one hour; coefficient 1).
The automated data processing test is an oral test (duration: 20 minutes, with preparation of the same duration; coefficient 1). »

Article 4 of the above-mentioned decree of 2 September 1992 is replaced by the following provisions:
"The members of the jury are appointed by order of the local authority of the community or institution that organizes the contest.
The jury at least includes:
(a) A territorial officer of category A or B and an official designated under the conditions set out in section 14 of the above-mentioned decree of 20 November 1985;
(b) Two qualified personalities;
(c) Two local elected officials.
For competitions organized by a non-affiliated community or institution, the representative of the management centre, a member of the jury under section 42 of the above-mentioned Act of January 26, 1984, is designated as one of the three colleges mentioned above.
Members of the jury shall be chosen, with the exception of the members referred to in section 42 of the Act of 26 January 1984 referred to above, from a list prepared annually or updated as necessary by the President of the Administrative Court, in the light of the proposals of the chair(s) of the management centres under the jurisdiction of that court. The proposals of non-affiliated communities are previously collected.
The order set out in the first paragraph of this article shall, among the members of the jury, designate its president and the replacement of the jury for the event that it is impossible to carry out its mission.
The jury may establish itself in groups of examiners, particularly in view of the number of candidates, with a view to correcting the written examinations and oral interrogations, under the conditions set out in section 44 of the aforementioned Act of 26 January 1984.
Correctors may be appointed by order of the competent territorial authority to participate in the correction of the tests, under the authority of the jury. »
