Considering articles L. 133-1 et seq. of the Labour Code;
In view of the decree of 8 February 1991 extending the national collective agreement of the workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees) of 8 October 1990;
Having regard to the decrees of 12 February 1991 and 15 December 1992 extending the national collective agreement of the workers employed by the construction companies referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees) of 8 October 1990 and supplementing it;
Having regard to Act No. 10 of 4 May 2004 on salaries to the regional agreement (High-Normandy) of 11 January 1991 entered into under the aforementioned national collective agreements;
Having regard to the Regional Agreement (Uppermandy) of 4 May 2004 on Small Displacement Allowances and the Reference Value, entered into under the aforementioned national collective agreements;
Considering the request for extension submitted by signatory organizations;
Having regard to the announcements in the Official Journal of 1 July 2004 and 10 July 2004;
Considering the opinions collected during the investigation;
Having regard to the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), collected in accordance with the procedure provided for in Article R. 133-2 of the Labour Code,
Stop:
It shall be made mandatory for all employers and all employees included in the field of professional application of the national collective agreement of the workers employed by the enterprises of the building referred to in the decree of March 1, 1962 (i.e. occupying up to ten employees) of October 8, 1990, as supplemented by the amendment number 1 of March 17, 1992, and the national collective agreement of the workers employed by the enterprises of the building not covered by the decree of March 1, 1962
- Act No. 10 of 4 May 2004 to the Regional Agreement (High-Normandy) of 11 January 1991 entered into within the framework of the above-mentioned national collective agreements, subject to the application of the provisions of Article 32 of Act No. 2000-37 of 19 January 2000 amended establishing a monthly compensation guarantee;
- the Regional Agreement (Upper Normandy) of 4 May 2004 on Small Displacement Allowances and the reference value of the aforementioned national collective agreements.
The extension of the effects and sanctions of the agreement and of the above-mentioned avenge shall be made on the date of the publication of this order for the remaining period and the conditions provided for by the said agreement and the said avenge.
The Director of Labour Relations at the Ministry of Employment, Labour and Social Cohesion and the Director General of Forest and Rural Affairs at the Ministry of Agriculture, Food, Fisheries and Rural Affairs are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
