Decree No. 2004-966 of 8 September 2004 on hardship allowance for commercial activity awarded to certain officers of the National Geographic Institute

The Prime Minister,
On the report of the Minister of State, Minister of Economy, Finance and Industry, Minister of Equipment, Transport, Land Management, Tourism and the Sea and Minister of Public Service and State Reform,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Considering the amended Decree No. 81-505 of 12 May 1981 on the National Geographical Institute;
Having regard to amended Decree No. 86-83 of 17 January 1986 on the general provisions applicable to non-State officials for the application of Article 7 of Act No. 84-16 of 11 January 1984, as amended,

Public servants, state workers and non-owned officers of the National Geographical Institute responsible for this establishment of commercial functions may, within the limits of the appropriations available for this purpose, receive a hardship allowance for commercial activity. This allowance shall be paid the calendar year following the service rendered prorata temporis by the agents concerned, as soon as the total amount of the goods resulting from the commercial activity of the establishment is known.
In the event of an officer's death, this allowance is, by exception to the principle set out in the preceding paragraph, paid within six months.

The compensation provided for in section 1 of this Order is payable by a decision of the Minister responsible for equipment or by a decision of the Director General of the National Geographical Institute.

The annual average amounts of this allowance shall be determined, for the officers referred to in section 1 by a base amount assigned to a liability coefficient dependent on the commercial employment held. The basic amount and the liability factors are determined by joint order of the Minister for Equipment, the Minister for Budget and the Minister for Public Service.

The amounts of the hardship allowance that may be served may be modulated to reflect the quality of the services rendered. However, the individual amount served cannot exceed double the average amount referred to in section 3.
The total amount of annual allowances awarded to the National Geographical Institute for Commercial Functions shall not exceed five per thousand of the total amount of goods resulting from the commercial activity of the establishment.

The Minister of State, Minister of Economy, Finance and Industry, the Minister of Equipment, Transport, Land Use Planning, Tourism and the Sea, the Minister of Public Service and State Reform and the Secretary of State for Budget and Budget Reform are responsible, each with respect to it, for the execution of this decree, which takes effect on 1 January 2004 and will be published in the Official Gazette of the French Republic.
