On the report of the Minister of Agriculture, Food, Fisheries and Rural Affairs,
Considering the rural code, including articles L. 813-8, R.* 813-18 and R.* 813-38;
Considering the education code;
Having regard to the opinion of the National Council for Agricultural Education of 23 April 2004;
The State Council (section of public works) heard,
Decrete:
Article R.* 813-38 of the Rural Code is replaced by the following provisions:
"Art. R.* 813-38. - The operating grant per student is made up, according to the mode of reception, of a share corresponding to the single outternate and, where applicable, of a second part corresponding to the restoration and a third part corresponding to the accommodation.
The amount of each share is determined by reference to the average cost per pupil of the corresponding expenses of public agricultural technical education institutions, calculated from a five-year survey conducted by the Ministry of Agriculture, on the basis of a reference sample of public agricultural technical education institutions whose distribution of training is comparable to that found in the establishments mentioned in Article L. 813-8 of the Rural Code.
The expenses referred to in the preceding paragraph include non-teacher personnel costs and operating expenses to the State and territorial authorities, according to the skills they exercise with respect to public agricultural technical education institutions.
The representative shares of the different host modes are set to 100% for single outing, 60% for catering and 50% for hosting the corresponding expenses of the public establishments constituting the reference sample.
Between two five-year surveys, the grant is indexed under conditions determined by a joint order of the Minister for Agriculture and the Minister for Budget.
Each year, an order of the same ministers sets, according to the mode of reception of the students, an average amount of subsidy to the same student for all associations or organizations responsible for private agricultural educational institutions. »
The last paragraph of Article R.* 813-18 is repealed.
The Minister of State, Minister of Economy, Finance and Industry, the Minister of Agriculture, Food, Fisheries and Rural Affairs, the Secretary of State for Budget and Budgetary Reform, and the Secretary of State for Agriculture, Food, Fisheries and Rural Affairs are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
