Decree of 23 August 2005 on the extension of regional agreements (Rhône-Alpes) concluded within the framework of the national collective agreements of the workers employed by the construction companies (companies up to ten employees and more than ten employees) (n°s 1596 and 1597)

Minister of Employment, Social Cohesion and Housing and Minister of Agriculture and Fisheries,
Considering articles L. 133-1 et seq. of the Labour Code;
Having regard to the decrees of 12 February 1991 and 15 December 1992 extending the national collective agreement of 8 October 1990 of the workers employed by the construction companies covered by the decree of 1 March 1962 (i.e. occupying up to ten employees) and supplementing it;
In view of the decree of 8 February 1991 extending the national collective agreement of 8 October 1990 of workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees);
Having regard to the decision of 13 September 2004 on the extension of a regional agreement (Rhône-Alpes) concluded under the aforementioned national collective agreement;
Having regard to the regional agreement (Rhône-Alpes) of 2 December 2004 on minimum wages, concluded in the framework of the national collective agreement of 8 October 1990 concerning workers employed by the construction companies covered by the decree of 1 March 1962 (i.e. occupying up to ten employees);
Having regard to the regional agreement (Rhône-Alpes) of 2 December 2004 on minimum wages, concluded in the framework of the national collective agreement of 8 October 1990 concerning workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees);
Considering the request for extension submitted by signatory organizations;
Having regard to the announcements in the Official Journal of 26 June 2005 and 7 August 2005;
Considering the opinions collected during the investigation;
Having regard to the reasoned opinion of the National Collective Bargaining Commission (subcommission of agreements and agreements), collected in accordance with the procedure provided for in Article R. 133-2 of the Labour Code,
Stop:

Article 1


For all employers and all employees included in the field of professional application of the national collective agreement of 8 October 1990 workers employed by the construction companies referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees) as supplemented by the Actor No. 1 of 17 March 1992, and in that of the national collective agreement of 8 October 1990 workers employed by the enterprises of the non-target building
- the regional agreement (Rhône-Alpes) of 2 December 2004 on minimum wages, concluded in the framework of the national collective agreement of 8 October 1990 concerning the workers employed by the construction companies covered by the decree of 1 March 1962 (i.e. occupying up to ten employees);
- the regional agreement (Rhône-Alpes) of 2 December 2004 on minimum wages, concluded under the national collective agreement of 8 October 1990 concerning workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e., occupying more than ten employees).

Article 2


The extension of the effects and sanctions of the above-mentioned agreements shall be effected on the date of the publication of this order for the remaining period of time and under the conditions provided for in these agreements.

Article 3


The Director of Labour Relations at the Ministry of Employment, Social Cohesion and Housing and the Director General of Forest and Rural Affairs at the Ministry of Agriculture and Fisheries are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
