Summary


Decree No. 96-956, amended by Decree 2000-380 of 28-04-2000, establishing a strengthened educational supervision grant for certain staff of the decentralised youth judicial protection services, provides for the award of this allowance to staff who are assigned and who perform their duties in the strengthened educational centres and the immediate placement centres. The creation of closed educational centres was decided by Parliament on the occasion of the vote of Law 2002-1138 of 09-09-2002 on guidance and programming for justice (LOPJ), with the aim of ensuring the care of multi-recidivist or violent minors, as an alternative to incarceration. This category of structure must accommodate minors under judicial supervision or who have been subjected to a suspended prison sentence and probation. The terms of reference for the operation of closed educational centres require, in accordance with the provisions of the LOPJ, enhanced educational action and strict control of the minors entrusted, including compliance with the obligations of presence in closed educational centres. Closed educational centres are structures whose operating and mentoring means are significantly strengthened. Staff assigned to closed educational centres (excluding administrative staff) will receive the enhanced education grant, with a higher rate determined by the enforcement order. In particular, this increase is justified for the sake of fairness of the staff assigned to other educational structures, particularly the strengthened educational centres, benefit from a benefit, at the level of the new indiciary bonus (NBI), which cannot be granted to agents assigned to closed educational centres. This change requires an amendment to Decree 96- 956. The amendment covers two points: it allows the extension of the scope of the educational supervisory bonus to be extended to the closed educational centres by amending the art. 1 listing the categories of beneficiary services; It also allows the differentiation of the amounts paid in favour of closed educational centres by amending the art. 2 and substituting the terms "annual amount is fixed" by "annual amounts ... are fixed".

Article 1 of the above-mentioned Decree of 30 October 1996 is replaced by the following provisions:
"Art. 1st. - A strengthened education grant, which is not subject to a civil pension pension allowance, is awarded to staff of the decicent youth judicial protection services, with the exception of administrative staff and administrative staff, who are assigned and who perform their duties in the strengthened educational centres, immediate placement centres and closed educational centres. The Enhanced Education Supervisory Award is exclusively allocated to the body-owned agents mentioned in a list prepared by joint order of the Seal Guard, Minister of Justice, Minister of Budget and Budget Reform and the Minister of Public Service, State Reform and Land Management. »

Article 2 of the above-mentioned Decree of 30 October 1996 is replaced by the following provisions:
“Art. 2. - The annual amounts of the premium provided for in section 1 are determined by joint order of the Seal Guard, Minister of Justice, Minister of Budget and Budget Reform and Minister of Public Service, State Reform and Land Management. »
