Considering articles L. 133-1 et seq. of the Labour Code;
In view of the decree of 8 February 1991 extending the national collective agreement of 8 October 1990 of workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees);
Having regard to the decrees of 12 February 1991 and 15 December 1992 extending the national collective agreement of 8 October 1990 of the workers employed by the construction companies referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees) and to amendments to it;
In view of the decree of 9 December 1993 and the successive decrees, including the decree of 6 November 2001, extending the collective agreement of the workers of the building of the Paris region of 28 June 1993 entered into within the framework of the aforementioned national collective agreements and amendments or supplementing it, including the departmental agreement (Seine-et-Marne) of 31 May 1995 annexed to this agreement;
Having regard to the departmental agreement (Seine-et-Marne) of 16 December 2002 on minimum wages concluded under the above-mentioned departmental agreement protocol annexed to the aforementioned regional collective agreement;
Having regard to the departmental agreement (Seine-et-Marne) of 16 December 2002 on small-travel allowances entered into under the above-mentioned departmental memorandum of understanding annexed to the aforementioned regional collective agreement;
Considering the request for extension submitted by signatory organizations;
Having regard to the announcements published in the Official Journal of 13 April, 2 May and 27 June 2003;
Considering the opinions collected during the investigation;
In view of the reasoned opinion of the National Commission for Collective Bargaining (subcommission of agreements and agreements), co-ordinated in accordance with the procedure provided for in Article R. 133-2 of the Labour Code,
Stop:
For all employers and all employees included in the field of professional application of the collective agreement of the workers of the building of the Paris region of 28 June 1993, that of the national collective agreement of 8 October 1990 of the workers employed by the enterprises of the building referred to in the decree of 1 March 1962 (that is, occupying up to ten employees), as supplemented by the occupancy decree of 17 March 1992, and that of
- the departmental agreement (Seine-et-Marne) of 16 December 2002 on minimum wages entered into under the above-mentioned departmental agreement protocol annexed to the above-mentioned regional collective agreement, subject to compliance with the provisions of Article 32 of Act No. 2000-37 of 19 January 2000 as amended establishing a monthly payment guarantee
- the Departmental Agreement (Seine-et-Marne) of 16 December 2002 on Small Displacement Allowances entered into under the above-mentioned departmental Memorandum of Understanding annexed to the aforementioned regional collective agreement.
The extension of the effects and sanctions of the above-mentioned agreements shall be effected on the date of the publication of this order for the remaining period of time and under the conditions provided for in these agreements.
The Director of Labour Relations at the Ministry of Social Affairs, Labour and Solidarity and the Director General of Forest and Rural Affairs at the Ministry of Agriculture, Food, Fisheries and Rural Affairs are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
