Decree No. 2005-1017 of 22 August 2005 on conditions of appointment and advancement in the leadership positions of the National Forestry Board

The Prime Minister,
On the report of the Minister of Agriculture and Fisheries, the Minister of Economy, Finance and Industry, the Minister of Public Service and the Minister of Ecology and Sustainable Development,
Considering the forest code;
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to the advice of the Central Joint Technical Committee of the National Forestry Board dated 1 July 2004;

This Order sets out the conditions for appointment and advancement in the leadership positions of the National Forestry Board, which are divided into two groups, Group I and Group II.
Group I includes the jobs of central or assimilated director, territorial director, Corsica-DOM coordinator and national delegate for mountain land restoration.
Group II includes the jobs of Deputy Central Director and Regional Director. It also includes the jobs of Project Manager, Department Manager, Agency Director and Territorial Services Officer, who are listed on a list prepared by the Board of Directors of the National Forestry Board on the proposal of the Director General, based on their high level of responsibility.

The central directors of the National Forestry and Assimilated Office carry out the duties entrusted to them by the Director General. They are assisted by deputy heads, project managers and heads of departments.
The National Mountain Field Restoration Officer is responsible for specialized technical services to prevent mountain-specific natural hazards.
Territorial Directors and Regional Directors provide direction to all the Agency's deccented services in the territories and regions at their head. Territorial directors are assisted by territorial service officials. The Corsica-DOM coordinator ensures coordination between the central and regional branches of Corsica and DOM.
The agency directors shall, under the authority of the territorial directors, provide the direction of the Agency's decentralized services.

I. - Can be appointed in a position of management of group I officials from one of the bodies recruited by the National School of Administration or the Polytechnical School, officials from the public service of the State, the territorial public service or the public service hospital and from another body or a framework of employment classified in category A or assimilated with a rough index
II. - Can be appointed in a position of management of group II officials belonging to a body recruited by the National School of Administration or the Polytechnical School, civil servants belonging to the public service of the State, the territorial public service or the public service hospital and belonging to another body or employment framework or occupying a position classified in category A or assimilated less

The appointment in management positions referred to in section 1 shall be made by the Director General of the National Forestry Board for a period of three years renewable.
Officials appointed in these jobs are placed in a position of detachment in their original body or employment framework.

An employee appointed in a management position referred to in section 1 may be removed from the position in the interest of the service.

Group I's management position has five steps. The actual service time spent in each step to reach the upper level is one year and six months in the first step and two years in the next steps.
Group II's management position has six ladders. The actual service time spent in each ladder to reach the upper ladder is fixed at one year and six months in the 1st, 2nd and 3rd and two years in the 4th and 5th ladders.

Officials appointed in a management position referred to in section 1 shall be classified at the level with an index immediately higher than that held in their original body or employment framework. However, when this classification is more favourable to them, officials who were in a functional position during the last six months prior to their appointment are classified at the level with an equal index or, if not, immediately higher than that of which they were in that position.
They shall retain, within the time limit required for access to the upper level, the seniority acquired in their previous grade or employment when the increase in treatment resulting from their appointment is less than or equal to that which would have resulted from a level advancement in their former grade or employment.
The appointed officials, while they had reached the highest level of their previous rank or employment, retain their seniority at the same time when the increase in salary following their appointment is less than that which resulted from the advancement at the latter level.
Employees who have reached their own bodies, employment framework or employment of origin a level with a higher index than that of the terminal level of employment to which they access retain, in their personal capacity, the index held in their own bodies, employment framework or employment of origin, until the day on which they receive, in one of the jobs mentioned in article 1st, an index at least equal.

I. - Officials who, on the date of publication of this decree, occupy a position governed by Decree No. 93-1293 of 3 December 1993 establishing the conditions of appointment and advancement in the jobs of Director, Head of Department, Regional Director and Departmental Director of the National Forestry Board are appointed and reclassified in accordance with the following correspondence tables:

II. - The services performed in the original employment governed by the decree of 3 December 1993 mentioned above are assimilated to services performed in the hospitality employment governed by this decree.

Decree No. 93-1293 of 3 December 1993 establishing conditions of appointment and advancement in the jobs of Director, Head of Department, Regional Director and Departmental Director of the National Forestry Board is repealed.

The Minister of Economy, Finance and Industry, the Minister of Agriculture and Fisheries, the Minister of Public Service, the Minister of Ecology and Sustainable Development and the Minister Delegate for Budget and State Reform, spokesperson for the Government, are responsible, each with regard to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
