Considering the code of the judicial organization, including article R. 213-29;
Having regard to amended Decree No. 64-754 of 25 July 1964 concerning the organization of the Ministry of Justice;
Having regard to Decree No. 87-389 of 15 June 1987 concerning the organization of central administration services, as amended by Decree No. 2005-124 of 14 February 2005, in particular Article 2 of the Decree;
Considering the advice of the technical committee of the central administration of the Ministry of Justice dated 4 March 2005;
The State Council (inland section) heard,
Decrete:
The above-mentioned decree of 25 July 1964 is amended in accordance with articles 2 to 6 of this decree.
After the first paragraph of Article 1 it is added a paragraph as follows:
" - the General Secretariat; "
It is added after section 1 of the articles 1st-1, 1st-2 and 1st-3 as follows:
"Art. 1-1. - The Secretary General assists the Minister, in liaison with the directors, for the following missions:
« 1° He is responsible for the policy of modernization, deconcentration and territorial organization of the ministry; it proposes the reform stat of the ministry and monitors the decided actions. In this regard, he represents the Minister in the relevant interdepartmental bodies.
"He animates and coordinates the IT and information and communication technology policy;
« 2° It participates in the determination of the objectives of the missions to which it is assigned to directors and heads of services directly attached to the Minister;
« 3° It is responsible for the evaluation actions carried out within the department and conducts a study of the consequences on the functioning of the courts and services of legislative and regulatory projects from the department or other jurisdictions. It may, for this purpose, request the assistance of the general inspection of judicial services;
« 4° It is responsible for the research policy and ensures its implementation;
« 5° He is responsible for the internal and external institutional communication of the ministry;
« 6° It is responsible for European and international cooperation activities; it provides its support to the relevant branches in the negotiation of international agreements;
« 7° It coordinates the actions in which the department is committed to the conduct of interdepartmental policies, including city policy.
"Art. 1-2. - For the purpose of carrying out his duties, he conducts the following services available to him:
“(a) The service of access to the law and justice and politics of the city;
“(b) The service of European and international affairs;
"(c) The central service of information and communication.
"He chairs the committee of directors and chiefs of service directly attached to the minister. The committee shall deliberate on matters submitted to it by the Minister or, within the limits of its powers, by the Secretary-General.
"Art. 1-3. - He is a senior defence officer and, as such, coordinates the department's security policy. »
The last paragraph of section 3 is replaced by the following provisions:
" - ensures the implementation of international conventions on mutual legal assistance and conducts, by combining the service of European and international affairs, European and international negotiations relevant to private law legislation;
" - contributes, in conjunction with the European and international affairs department, to the application of other international conventions and European law. »
The last paragraph of section 4 is replaced by the following provisions:
" - ensures the implementation of international conventions on mutual legal assistance in criminal matters and conducts European and international negotiations involving the service of European and international affairs relevant to criminal legislation;
" - contributes, in conjunction with the European and international affairs department, to the application of other international conventions and European law. »
The fourth and fifth paragraphs of Article 7-2 are replaced by the following:
" - is associated by the Directorates to the representation of the Ministry of Justice in European and international negotiations and meetings;
" - ensures, in connection with the directions, the application of international conventions and European law".
The Decree of March 24, 1937 regulating public administration relating to the organization of the central administration of the Ministry of Justice is repealed.
The Seal Guard, Minister of Justice, and the Minister of Public Service are responsible, each with respect to it, for the execution of this Order, which will be published in the Official Journal of the French Republic.
