In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State, in particular its article 58;
Having regard to amended Decree No. 93-34 of 11 January 1993 on the special status of the bodies of officials of the French Refugee and Stateless Protection Agency;
Having regard to amended Decree No. 94-1016 of 18 November 1994, setting out the common statutory provisions applicable to various bodies of officials in category B, including article 11 of the Statute;
Considering the advice of the Central Joint Technical Committee of the French Agency for the Protection of Refugees and Stateless Persons dated 13 December 2005;
The State Council (Finance Section) heard,
Decrete:
Article 4-1 of the aforementioned Decree of 11 January 1993 is replaced by the following provisions:
"Art. 4-1. - The body of refugee and stateless secretaries includes:
1° The rank of normal class protection secretary, divided into 13 steps;
2° The rank of Superior Protection Secretary, divided into 8 steps;
3° The rank of exceptional class protection secretary, divided into 7 steps.
The rank of normal-class protection secretary, the rank of superior protection secretary and the rank of exceptional class protection secretary are assimilated, respectively, to the grade of normal-class, to the grade of superior-class and to the grade of exceptional class provided for in article 1 of the aforementioned decree of 18 November 1994.
The number of senior protection secretary jobs cannot exceed 25 per cent of the total number of jobs in the first two grades. »
Article 8-1 of the same decree is replaced by the following provisions:
"Art. 8-1. - The conditions of access to the rank of Superior Protection Secretary and the rank of Special Class Protection Secretary are those established by Article 11 of the above-mentioned Decree of 18 November 1994.
The advance to the rank of secretary of exceptional class protection provided for in a of II of Article 11 of the above-mentioned decree of 18 November 1994 shall take place by way of registration to an annual progress table, prepared after notice of the parity administrative commission, after a selection by professional examination. »
Until the installation, within the maximum period of one year from the date of publication of this decree, of the administrative commission of the body of the protection secretaries in its composition resulting from article 1 of this decree, the representatives of the rank of secretary of protection of the upper class shall ensure the representation of the rank of secretary of protection of the upper class and the rank of secretary of protection of the exceptional class.
The Minister for Foreign Affairs, the Minister of Economy, Finance and Industry, the Minister of Public Service and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
