Judgment of 28 July 2005 fixing the date of the elections for the appointment of staff representatives to the competent national parity boards with respect to the bodies of technical social service advisers and social service assistants

Minister of State, Minister of Interior and Land Management,
In light of amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants, together with amended Act No. 84-16 of 11 January 1984 on statutory provisions relating to the public service of the State;
Having regard to amended Decree No. 82-451 of 28 May 1982 on Administrative Committees;
Having regard to amended Decree No. 91-784 of 1 August 1991 on the common statutory provisions applicable to the bodies of the technical advisers of social service of the State administrations and Decree No. 91-783 of 1 August 1991 on the common provisions applicable to the bodies of the social service assistants of the State administrations;
In view of the decision of 9 September 1992 establishing competent national parity administrative commissions with regard to the bodies of technical social service advisers and social service assistants;
In view of the decision of 8 January 1996 setting out the terms and conditions for the election of staff representatives to the Joint Administrative Committees under the overall direction of the administration of the Ministry of Interior;

Article 1


The date of the elections for the appointment of staff representatives in the relevant national parity boards with respect to the bodies of technical social service advisors and social service assistants of the Ministry of Interior and Land Management is Tuesday, 22 November 2005.

Article 2


In order to carry out the above-mentioned electoral operations, a polling station is established at the central administration of the Ministry of Interior and Land Management.

Article 3


The election will be conducted by mail only under the conditions set out in the Interdepartmental Order of January 8, 1996, setting out the terms and conditions for the election of staff representatives to the Joint Administrative Committees under the general direction of the administration of the Ministry of Interior.

Article 4


Candidates' lists and nominations must be filed at least six weeks before the date of the vote, no later than Monday, October 10, 2005, at 5 p.m., at the General Secretariat, Human Resources Directorate (staff management, employment, finance and legal affairs office), room 848, 7, rue Nélaton, 75015 Paris.
Upon verification of the eligibility conditions of candidates, which will take place until 13 October 2005, any necessary corrections may be made until 17 October 2005, at 5 p.m.

Article 5


Lists of electors established and arrested by the Minister of State, Minister of Interior and Land Management, will be posted in each department and central government on or before Friday, November 4, 2005.
Within eight days, until November 14, 2005, at 5 p.m., applications for registration and claims will be filed with the Employment, Finance and Legal Affairs Office.
Within the same period and for three days from its expiry, until 17 November 2005, at 5 p.m., claims may be filed concerning registrations or omissions on the lists of electors.

Article 6


In the absence of a list by representative trade union organizations on 10 October 2005, a second ballot will be held on 6 December 2005. The deadline for filing the lists of candidates as well as nominations will be October 24, 2005, at 5 p.m., for the General Secretariat, Human Resources Directorate (staff management, employment, finance and legal affairs office), room 848, 7, rue Nélaton, 75015 Paris.
If, in the vote of November 22, 2005, the number of voters is less than half the number of registered electors, a second ballot will be held on Tuesday, January 17, 2006. The deadline for the filing of the lists of candidates and nominations will be 5 December 2005, at 5 p.m., for the General Secretariat, Human Resources Directorate (staff, employment, finance and legal affairs office), room 848, 7, rue Nélaton, 75015 Paris.

Article 7


On 22 November 2005, at 5 p.m., the correspondence envelopes received are recorded.

Article 8


Census, vote counting and results proclamation operations are scheduled for November 24, 2005, starting at 9 a.m.

Article 9


The Secretary-General and the prefects are responsible, each with respect to him, for the execution of this order, which will be published in the Official Journal of the French Republic.
