Having regard to Decree No. 90-839 of September 21, 1990, as amended concerning the special status of the administrative staff of the public hospital service;
Considering Decree No. 91-45 January 14, 1991, amended on the special status of workers, car drivers, ambulance drivers and staff personnel maintenance and safety of the public hospital service;
Considering Decree No. 91-129 of 31 January 1991 amended concerning the special status of psychologists of the public hospital service;
Considering Decree No. 91-868 September 5, 1991, amended on the particular statutes of the public hospital service technical staff;
Mindful of Decree No. 2001 - 1207 of 19 December 2001 on the special status of the body of the Hospital Authority clamps and amending Decree No 90 - 839 21 September 1990 on the special status of the administrative staff of the public hospital service;
Mindful of Decree No. 2007-1188 to August 3, 2007 on the special status of the body of orderlies and hospital services officers qualified hospital public service;
Having regard to the opinion of the High Council of the function public hospital dated February 22, 2007;

I. - Effective January 1, 2008, the maximum number of advancement of rank within the body of the public hospital service is in the institutions mentioned in article 2 of the Act of 9 January 1986 above and where the particular statutes of these bodies provide, determined each year by applying a rate of promotion. This rate applies to the number of officials eligible for an advancement in rank to 31 December of the year preceding that in respect of which promotions are pronounced. An order of the Minister of health sets the rate of promotion, and includes an appendix which contains the list of the bodies covered by this device.
II. - Before signature by the Minister of health, the draft decree establishing the promotion rate is passed, to assent to the Minister of public service and the Minister in charge of the budget. This notice is deemed acquired in the absence of observations within a period of ten days from the receipt of the referral.

When the number of promotions calculated in accordance with article 1 is not an integer, decimal is added to the number calculated in respect of the following year.
However, when the application of the foregoing provisions does not make appointment for two consecutive years, an appointment in the grade of progress may be imposed the third year. In this case, the accumulation of decimals is not postponed the following year.

Decree No. 2002-782 3 May 2002 on the advancement in rank in some body of the public hospital service is hereby repealed as from 1 January 2008.
In all the statutory and regulatory texts, reference to this order is replaced by the reference to this Decree.

The Minister of health, youth and sports, the Minister of budget, public accounts and public service and the Secretary of State for public service are responsible, each in relation to the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
