Decree No. 2005-919 of 2 August 2005 amending the statutory provisions relating to the body of the assistants of the technical frameworks of the Paris Public-Hospital Assistance and amending Decree No. 93-145 of 3 February 1993 amended bearing the special statutes of the technical staff of the Paris Public-Hospital Assistance

The Prime Minister,
On the report of the Minister of Health and Solidarity,
Having regard to the amended Act No. 83-634 of 13 July 1983 on the rights and obligations of civil servants;
Having regard to Act No. 86-33 of 9 January 1986, amended with statutory provisions relating to the public hospital service, including section 103;
Having regard to amended Decree No. 93-101 of 19 January 1993 on the access of citizens of other Member States of the European Community or of another State Party to the agreement on the European Economic Area to certain bodies of the public hospital service;
In view of the amended Decree No. 93-145 of 3 February 1993 on the special statutes of the technical staff of the Paris State Hospital Assistance;
Having regard to amended Decree No. 94-616 of 21 July 1994 concerning the assimilation, for access to competitions or examinations of the public hospital service, of titles or diplomas issued in other Member States of the European Community or in another State Party to the Agreement on the European Economic Area;
In view of the amended Decree No. 2002-616 of 26 April 2002, pursuant to articles L. 335-6 of the Education Code and L. 900-1 of the Labour Code, relating to the national register of professional certifications;
Considering the opinion of the Superior Administrative Council of the Paris Public Hospital Assistance dated 14 June 2004;
Having regard to the advice of the Director General of the Paris Public Hospital Assistance dated 12 July 2004;
The State Council (Social Section) heard,
Decrete:

The above-mentioned decree of 3 February 1993 is amended:
I. - Section 10 is replaced by the following provisions:
“Art. 10. - The superior technicians of the Paris Public Hospital Assistance participate, under the authority of the Chief of Institution or, if any, of the engineer to whom they are assigned, in the preparation and control of the execution of technical or scientific operations.
"They collaborate in the development of new and maintenance projects, can be invested in the technical management of a part of the service and responsible for the operation, maintenance, maintenance and control of certain high-tech equipment.
"They perform their duties, according to their specialty, in the areas of technical management and logistics, biomedical techniques, drawing, hygiene, security and the environment, prevention and management of risks, quality and accreditation, computing, telecommunications and information systems, organizational techniques, communication techniques and other scientific activities, as well as
"The superior hospital technicians heads of the Paris Public Hospital Assistance and senior hospital technicians of the Paris Public Hospital Assistance are responsible for the supervision of staff or, under the authority of a supervisor, the management of a service section, a technical service, cross-cutting missions, studies or projects.
"The superior hospital technicians of the Paris Public Hospital Assistance may be entrusted with the supervision of personnel in the areas of their competence.
"For the duration of the internship provided for in section 25 of this decree, the superior technicians of the Public Hospital Assistance in Paris receive training to adapt to their employment whose duration and content are fixed by order of the Minister for Health, on the proposal of the Director General of the Public Hospital Assistance in Paris. »
II. - Section 11 is replaced by the following:
“Art. 11. - The body of the superior technicians of the Paris Public Hospital Assistance includes three grades: the hospital technician of the Paris Public Hospital Assistance with 13 ranks, the main hospital technician of the Paris Public Hospital Assistance with eight ranks, senior hospital technician, head of the Paris Public Hospital Assistance with eight ranks. »

III. - Section 12 is replaced by the following:
“Art. 12. - The superior hospital technicians of the Paris Public Hospital Assistance are recruited:
« 1° Pursuant to section 29 of the above-mentioned Act of 9 January 1986:
“(a) For 40% of the positions to be filled, by external competition on titles open to holders of a diploma sanctioning a first cycle of graduate studies, a title or diploma approved at level III or a certification registered in the national directory of professional certifications issued in one or more of the specialties listed in the third paragraph of section 10 of this Order.
"This competition is also open to candidates who hold a diploma issued in another Member State of the European Community or in another State Party to the Agreement on the European Economic Area and whose assimilation, for the application of this decree, with one of the diplomas provided for in the preceding paragraph, has been recognized by the commission provided for by the decree of 21 July 1994 referred to above;
“(b) For 40% of the positions to be filled, by internal competition open to public officials and public officials as well as to officials in office in an intergovernmental international organization on the closing date of registration with at least four years of public service as of 1 January of the year for which the competition is held;
"(c) For 20% of the positions to be filled, by means of an open-ended contest for the exercise, for a period of at least four years, of one or more professional activities, of one or more term as a member of an elected assembly of a territorial community or of one or more activities carried out as the head of an association. These activities shall be in accordance with functions relating to technical projects or work carried out in the areas listed in the third paragraph of Article 10 of this Decree.
"The jobs offered to the three contests that would not have been filled by the nomination of candidates for one of the contests can be awarded by the jury to the external competition and the internal competition. This postponement may result in the fact that the number of jobs offered to one of these competitions is greater than two thirds of the total number of places offered to the three competitions.
"The contests mentioned in a, b and c above are opened in one or more of the specialties listed in the third paragraph of Article 10 of this Decree;
« 2° Pursuant to the 1st of section 35 of the Act of 9 January 1986 referred to above, within one third of the number of titularizations pronounced under this section by open professional examination:

“(a) To the assistants of the hospital administrators and the medical secretaries of the institutions mentioned in section 2 of the above-mentioned Act of 9 January 1986, as well as to the technical agents of the coordination of the Paris Public Hospital Assistance;
“(b) To technical agents, state workers, state workers bleachers, ambulance drivers and specialized technical agents of the Paris Public Hospital Assistance, justifying at least nine years of actual service in one or more of these bodies. »
IV. - Section 13 is replaced by the following:
“Art. 13. - The average seniority to access the upper level in the rank of hospital technician of the Paris Public Hospital Assistance is fixed as follows:

V. - Section 14 is amended to read:
1° In the first paragraph, the words "from 1 August 1996" are deleted;
2° In the last paragraph, the words "25%" are replaced by the words "30%".
VI. - Section 15 is replaced by the following:
“Art. 15. - The average seniority to access the upper level in the rank of senior hospital technician of the Paris Public Hospital Assistance is fixed as follows:

VII. - In the first paragraph of Article 16, the words "from 1 August 1996" are deleted.
VIII. - Section 17 is replaced by the following:
“Art. 17. - The average seniority to access the upper level in the rank of senior hospital technician of the Paris Public Hospital Assistance is fixed as follows:

IX. - Section 24 is amended as follows:
1° In the first paragraph of the VII, the number "12" is deleted.
2° The second paragraph of the VII is replaced by the following:
"When there is only one job to be filled, this job is indifferently provided either under the a or b of the 1st of Articles 4, 12 and 20 of this decree, either under the 1st or 2nd of Article 5, or under the c of Article 12. »

X. - The first sentence of Article 26 III is amended to read:
"The officers appointed in the body of the assistants of the technical executives following a contest and who have previously had either the quality of a non-permanent agent or the quality of agent of an intergovernmental international organization are classified at the time of their tenure" (the rest without change).
XI. - The first sentence of Article 29 I is replaced by the following provisions:
"Can be detached from one of the bodies referred to in Article 1 above, with equal grade equivalence and index, or, if not, immediately higher, officials belonging to a body, employment framework or employment ranked in the same category and whose highest grade terminal index is at least equal to the terminal index of the host body. »
XII. - Section 42 is replaced by the following:
“Art. 42. - For a period of four years from the publication of Decree No. 2005-919 of 2 August 2005, the internal competition provided for in Article 12(b) of this Decree shall be reserved, for 50% of the positions offered to this contest, to officials from the bodies of technical coordination officers and specialized technical officers justifying at least four years of actual service. »
XIII. - Section 43 is replaced by the following:
“Art. 43. - By derogation from the provisions of Article 12 of this Decree, the number of positions placed in the contests reserved under the 1st of Article 12 may be increased to 35% more than the number of positions to be filled for the first three contests held from the publication of Decree No. 2005-919 of 2 August 2005, without altering the distribution of the positions offered between the external and internal competitions. »
XIV. Sections 44, 45, 46, 46-1, 47, 48 and 49 are repealed.

In the regulations relating to the Paris Public Hospital Assistance:
I. - The words: "Deputy of Technical Frameworks", "Deputy of Normal Class Technical Frameworks", "Deputy of Senior Technical Frameworks" and "Deputy Class Technical Frameworks" are replaced respectively by the words: "Superior Technician of the Public Hospital Assistance in Paris", "Superior Hospital Technician of the Paris Hospital and Hospital Assistant"
II. - References to title IV of the general status of civil servants are replaced by references to Act No. 86-33 of 9 January 1986 amended with statutory provisions relating to the public hospital service.

The provisions of this Decree shall take effect on 2 January 2004.

The Minister of Economy, Finance and Industry, the Minister of Health and Solidarity, the Minister of Public Service and the Minister for Budget and State Reform, the spokesperson for the Government, are responsible, each with regard to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
