Summary


The above-mentioned Decree 2002-237 derogating from the minimum working and rest guarantees applicable to deposit and consignment (CDC) staff was developed in accordance with Art II. 3 of Decree 2000-815 of 25-08-2000 on the development and reduction of working time in the public service of the State. It sets out the conditions under which it is derogated from the minimum working and rest guarantees with respect to personnel performing the duties of a security officer in a 24-hour custody system. In order to take into account the operational requirements of the car service of the deposit box and the reality of the working conditions of the drivers, particularly marked by peaks of activity early in the morning and at the end of the evening, it is necessary to complete the above-mentioned decree of 2002 by establishing an exemption covering the daily rest period applicable to these agents. So is it proposed to insert, after art. 2 of this text an art. 2-I intended to fix the minimum daily rest of the drivers at 10 a.m. instead of 11 a.m. This Order provides that, in return, the persons concerned shall be compensated under the compensation scheme that is paid to them. In addition, Decree 2000-815 provides, in its art. 8, the possibility of establishing, for the bodies or jobs whose missions involve a time of presence higher than the actual working time, a system of equivalence to the legal duration of the working time. Article 2 to 4 of this Decree is intended to establish such a system for the drivers and officers of the CDC. The missions attached to these jobs involve waiting or rest periods during the working day. Constraints are different depending on their assignment, differential treatment has been provided for each category of officers concerned: management drivers, other drivers and bailiffs. These art. also establish, in order to ensure clarity and transparency, the maximum weekly duration of presence and the maximum amplitude of the working day, according to the established equivalence coefficient. It should be noted that overtime beyond the statutory working hours will be processed in accordance with existing regulations and within the authorized effective working time limit.

In view of Decree No. 98-596 of 13 July 1998 on the conditions for the recruitment of contractual agents under the collective agreements by the Caisse des dépôts et consignations and the consultation bodies specific to the establishment;
In view of Decree No. 2000-815 of 25 August 2000 on the development and reduction of working time in the public service of the State, including Articles 3 and 8;
In view of Decree No. 2002-237 of 20 February 2002, derogating from the minimum working and rest guarantees applicable to the Caisse des dépôts et consignations personnel;
Considering the advice of the Joint Hygiene and Central Security Committee of the Caisse des dépôts et consignations dated 18 June 2002;
Having regard to the opinion of the Central Joint Committee of the Caisse des Dépôts et consignations dated 26 June 2002;
Considering the opinion of the Conseil supérieur de la service publique de l'État dated 6 February 2003;

After Article 2 of the above-mentioned Decree of 20 February 2002, an article 2-I is inserted as follows:
"Art. 2-I. - For the organisation of the work of the drivers of the automobile service of the Caisse des dépôts et consignations assigned to the transport of persons, and by derogation from the minimum guarantees mentioned in I of article 3 of the decree of 25 August 2000 referred to above, the minimum daily rest is fixed at ten hours. During a working day, the driving time of vehicles cannot exceed eight hours.
"The officers, referred to in the preceding paragraph, shall be compensated for their duties and compensation under the compensation scheme applicable to them. »

The time for the presence of the drivers of the car service of the Caisse des dépôts et consignations assigned to the transportation of management personnel is 55 hours per week. This duration is equivalent to a working week of 38.30 minutes.

The time for the presence of the drivers of the car service of the Caisse des dépôts et consignations assigned to the carriage of personnel other than those mentioned in section 2 is 46 hours per week. This duration is equivalent to a working week of 38.30 minutes.

The time for the presence of the bailiffs assigned to the general management of the Caisse des dépôts et consignations is 45 hours per week. This duration is equivalent to a working week of 37.30 minutes.

The Minister of Economy, Finance and Industry, the Minister of Public Service, State Reform and Land Management and the Minister Delegate for Budget and Budget Reform are responsible, each with respect to it, for the execution of this decree, which will be published in the Official Journal of the French Republic.
