Summary the Decree 2002-237 above-mentioned derogations to minimum guarantees for hours of work and rest for personnel of the caisse des dépôts and consignments (CDC) was developed in application of art II. 3 of Decree 2000-815 of 25-08 - 2000 on development and the reduction of working time in the civil service of the State. It sets out the conditions in which it is derogated from minimum guarantees of work and rest regarding personnel performing the functions of safety officer according to a system of custody of 24 consecutive hours. To take into account the operational needs of the automobile service Fund of deposits and the reality of the working conditions of drivers, particularly marked by spikes of activity early in the morning and late evening, it is necessary to supplement the Decree of 2002 supra by establishing a derogation concerning the daily length of rest for these agents. So is it proposed to insert, after the art. 2 this text art. 2 I intended to fix the minimum daily rest of drivers to 10 hours instead of 11 hours. The present Ordinance provides that in return, they shall have a compensation in respect of the allowance system that is paid. Furthermore, Decree 2000-815 provides, in his art. 8, the possibility of instituting a system of equivalence to the legal duration of work time for the body or jobs whose missions involve a time of presence more than the actual working time. The art. 2 to 4 of this Decree are designed to implement such a system for drivers and the bailiffs of the CDC. Missions attached to these jobs involve indeed to wait or rest periods during the working day. The constraints are different depending on their assignment, differentiated treatment has been provided for each category of agents involved: drivers of direction, other drivers, and the ushers. These art. also, fix in a concern for clarity and transparency, the weekly maximum of presence and the maximum amplitude of the working day, in application of the coefficient of equivalence established. It should be noted that overtime beyond the legal weekly working time will be processed in accordance with the regulations in force and within the limits of the authorized effective working time.

According to article 2 of the Decree of February 20, 2002 referred to above, it is inserted an article 2-I thus: 'art. 2 i. - for the Organization of the work of the drivers of the automobile service of the Caisse des dépôts and consignments assigned to the transport of persons, and by derogation from the minimum guarantees described in the I of article 3 of the Decree of 25 August 2000 referred to above, the minimum daily rest period is fixed at ten hours. During a working day, the driving time may not exceed eight hours.
"Workers, mentioned in the previous paragraph, receive in return for their constraints of functions, compensation in respect of the allowance system that applies to them."

The time of presence of drivers of the automobile service of the Fund of the deposit and consignment office used for the carriage of the management is 55 hours a week. This time is equivalent to a working week of actual work in 38 hours and 30 minutes.

The time of presence of the drivers of the automobile service of the Fund of the deposit and consignment office assigned to transport personnel other than those mentioned in article 2 is 46 hours per week. This time is equivalent to a working week of actual work in 38 hours and 30 minutes.

The time of presence of bailiffs assigned to the service of the Directorate-General of the Caisse des dépôts and consignments is 45 hours per week. This time is equivalent to an actual work of 37 h 30 minutes weekly.
