Having regard to directive 94/55/EC of the Council of 21 November 1994 as amended on the approximation of the laws of the Member States concerning the carriage of dangerous goods by road;
Having regard to directive 96/35 of the Council of 3 June 1996 on the appointment and vocational qualification of safety advisers for the transport by road, rail or inland waterway of dangerous goods;
Having regard to Act No. 263, on February 5, 1942 on the transport of dangerous goods;
Pursuant to law n 75-31 December 1975 1335 modified relative to the determination and the Suppression of offences in the public and private transport;
Having regard to the code of the road;
Having regard to Decree No. 60-794 22 June 1960 on the publication of the European Agreement concerning the international carriage of dangerous goods by road and the subsequent amendments made to annexes A and B of this agreement;
Having regard to Decree No. 77-1331 30 November 1977 concerning certain offences under the rules on the transport of hazardous materials;
Having regard to Decree No. 90-897 1 October 1990 regulating Fireworks.
Having regard to Decree No. 2001-386, 3 May 2001 amended on transportable pressure equipment;
Having regard to the order of 7 June 1977 as amended relating to the marking of roads and highways;
Considering the Decree of 19 November 1995 as amended relating to combating emissions of volatile organic compounds;
Having regard to Decree of 1 June 2001, as last amended by the Decree of 20 December 2004, concerning the carriage of dangerous goods by road said "arrêté ADR".
Having regard to the opinion of the interministerial commission for the transport of goods dangerous (CITMD) held on 22 June 2005, stop: Article 1 the Decree of 1 June 2001 referred to above says "ADR order" is amended as follows: Article 4 bis provisions relating to safety.
It is created a new article which reads: "it is deemed to meet the requirements of the 1.10.3.2 If the company has implemented a plan of safety developed as per the guide of CIFMD (interprofessional Committee for the development of training in the transport of dangerous goods) published in the official Bulletin.
With regard to nuclear material as defined in article l. 1333-1 of the defence code, this provision is not exclusive of the application of the rules on their control and their protection. In this case, the documents relating to their physical protection, including the security plan, are subject to the provisions relating to the protection of the confidentiality of national defence, and may be disclosed only to persons with a need to know. Article 43 certificates of approval of packagings, IBCs and large packagings in accordance with 6.1, 6.3, 6.5 or 6.6.
In paragraphs 1 and 3, in the second paragraph, change the first part of sentence to read: 'these licences which are designed to allow the manufacture of packagings in accordance with approved type are issued for a period of five years.'
In paragraph 4, create a second paragraph written as follows: "the duration of use of packaging, where it is limited by legislation, is determined from the date shown on the marking of packaging."


Appendix d. 1. -Provisions relating to hoses.
In paragraph 2.2, amend the third paragraph as follows: ' hoses made from pipes that are not rubber must meet the requirements of the standard referred above as regards the following points: Chapter 3: nominal pressures. ''
Chapter 7: marking. ' Article 2 application Date. -The provisions of this order come into force on July 1, 2005.


Article 3 the Director general of the sea and transport and the Director general of nuclear safety and radiation protection are responsible, each in relation to the execution of this order, which will be published in the Official Journal of the French Republic.
