Judgment of July 19, 2005 fixing the balances for fiscal year 2003 and the advances for fiscal year 2004 for compensation in respect of insurance against occupational accidents and diseases referred to in sections L. 134-7 to L. 134-11 of the Social Security Code

Minister of Economy, Finance and Industry, Minister of Health and Solidarity and Minister of Agriculture and Fisheries,
Considering the social security code, including articles L. 134-7 to L. 134-11 and D. 134-42 to D. 134-46;
Considering the rural code, in particular chapter 1 of title III of Book VII;
Having regard to the March 11, 2004 order setting the balances for the fiscal year 2002 and the instalments for the fiscal year 2003 for compensation for insurance against occupational accidents and diseases referred to in sections L. 134-7 to L. 134-11 of the Social Security Code;
In the opinion of the Industrial Accidents and Occupational Diseases Commission dated 9 February 2005, Stop:

Article 1


For the year 2003, the balances of compensation referred to in sections L. 134-7 to L. 134-11 of the Social Security Code are set as follows:
- positive balance in the general regime: 111,295,468;
- negative balance due to the agricultural wage system: 107,354,780;
- negative balance due to the regime of agricultural workers in Bas-Rhin, Haut-Rhin and Moselle: 3,940,688 .

Article 2


Taking into account the payments made under section D. 134-44 of the Social Security Code for 2003:
- the National Health Insurance Fund for Employees pays 2,132,444 to the Central Fund for Agricultural Social Community;
- the National Health Insurance Fund for Employees pays 385,165 to the Agricultural Employees of the Lower Rhine, Upper Rhine and Moselle.

Article 3


As part of the compensation for the fiscal year 2004, the general plan pays to the two agricultural plans concerned, at the beginning of each quarter of 2005, deposits equal to one-quarter of the amounts referred to in section 1.

Article 4


The Budget Director at the Ministry of Economy, Finance and Industry, the Director of Social Security at the Ministry of Health and Solidarity and the Director General of the Forest and Rural Affairs at the Ministry of Agriculture and Fisheries are responsible, each with regard to the execution of this Order, which will be published in the Official Journal of the French Republic.
