Judgment of 17 July 2003 approving the merger involving the transfer of portfolios of membership bulletins to regulations and mutual contracts

Minister of Social Affairs, Labour and Solidarity and Minister of Health, Family and Persons with Disabilities,
Considering the code of mutuality, including articles L. 212-11 and L. 212-12;
Having regard to the application by the mutual interprofessional Alliance (AMI), whose head office is in Toulouse (31000), 55 rue des Couteliers, and the mutual South-West mutuality, whose head office is in Tarbes (65020), 11, boulevard du Martinet, for the approval of the transfer, with its rights and obligations, by way of merging-absorption, of their portfolio of newsletters to regulations
Considering the deliberations of 10 October and 13 December 2002 of the General Assembly of the Mutual Interprofessional Alliance;
In view of the deliberations of 15 December 2001 and 5 October 2002 of the General Assembly of the Pyrenees-Bigorre Mutuelle;
Considering the deliberation of 28 November 2002 of the General Assembly of the South-West mutuality;
In view of the notices published in the Official Journal of 3 January 2003, inviting creditors of the concerned mutual funds to submit their comments on the transfer projects;
Considering the solvency certificate issued on 16 May 2003 by the Mutual and Provident Institutions Monitoring Committee;
Given the supporting parts,
Stop:

Article 1

It is approved, as of January 1, 2002, the merger involving the transfer, under the conditions provided for in article L. 212-11 of the code of mutuality, with its rights and obligations, of all portfolios of newsletters of membership to the regulations and contracts of the mutual alliance interprofessional mutual alliance and of the mutual South-West mutuality for the benefit of the Mutuelle Pyrénées-Bigorre.

Article 2

The Director of Social Security is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
