    The Prime Minister,
    On the report of the Minister of State, Minister of Economy, Finance and Industry, the Minister of the Public Service and the Reform of the State and the Minister Delegate to Industry,
    In the light of Law No. 83-634 of 13 July 1983 as amended bearing the rights and obligations of civil servants, Together the amended Act No. 84-16 of 11 January 1984 laying down statutory provisions relating to the public service of the State;
    As amended by Act No. 90-568 of 2 July 1990 on the organisation of the public service of the post and of the Telecommunications, in particular Articles 29 and 29-1;
    In the light of Decree No. 93-515 of 25 March 1993 on the statutory provisions applicable to the corps of executives of La Poste and the corps of executives of France Télécom;
    In view of the opinion of the Joint Committee of France Télécom as of 20 February 2004;
    In view of the Commission's opinion Staff and social affairs as of 24 February 2004;
    In view of the opinion of the State Civil Service Council of 9 March 2004;
    The Conseil d' Etat (Finance Section) heard,
    Describes:

    • TITLE I: GENERAL PROVISIONS Article 1


      This Decree lays down the special status of the corps of executives of France
      . Officials, within France Telecom, assume managerial or advisory responsibilities, which they may be required to carry out in the various fields of business activities of the company.

      Article 2


      The Corps of executives of France Telecom comprises the rank of first level executive with thirteen rungs and an exceptional step and the rank of second level executive with 15 levels.

      Article 3


      The President of France Telecom sets out the list of professional specialities exercised by The members of the body governed by this Decree and shall define the functions Corresponding to each grade of this body.

    • TITLE II: RECRUITMENT Article 4


      Executive frames Level of France Télécom are recruited under the following conditions:
      1 ° A first closed competition is reserved:
      (a) At the operating managers and control agents of France Télécom having reached the 5th echelon or the 4th step of their grade and justifying at least three years of effective service to France Télécom;
      (b) To officials De France Télécom holders of the ranks of the divisional controller, chief technician, chief draftsman, chief of work of the motor service, district chief, head of sector or head of establishment of 3rd class justifying at least Three years of effective service in their rank.
      2 ° A second competition Internal is reserved for officials of France Télécom holders of a grade other than those mentioned in 1 ° and justifying at least four years of effective services in France Télécom.
      3 ° Within the limit of one sixth of the number of appointments In the course of the competitions provided for in the 1 ° and 2 °, a professional examination is reserved for employees of France Télécom justifying at least eight years of effective services in France Télécom.
      The seniority requirements for services required To this Article shall be assessed on the closing date of the
      . Allocation of places between the two competitions mentioned at 1 ° and 2 ° is fixed by decision of the President of France Télécom. Competitions that would not have been filled by the appointment of candidates to one of these competitions may be awarded to candidates in the other competition.
      The first-level managers recruited under this section Are appointed upon appointment to that rank.

      Article 5


      The competitions and the professional examination provided for in Article 4 may Be organized by professional specialties.

      Article 6


      Can run for professional access to second level executive grade level provided for in article 10 Of France Télécom holders of the ranks of Inspector, Reviewer, Chief of Establishment of 2nd Class or Head of Establishment of 1st Class and justifying four years of effective service to France Télécom on the closing date of the Enrollments.
      Second-level managers recruited under the present Article shall be established upon appointment in that grade and shall be classified in accordance with the provisions of Article 7.

      Article 7


      I. -The operating executives and master's officers of France Télécom appointed in the grade of first-level framework for the first internal competition or the professional examination provided for in Article 4 shall be classified in their new grade According to the following table:

      II. -Officials of France Télécom other than those mentioned in the I and appointed in the grade of the first level framework for the internal competitions or the professional examination are classified in their new grade at the level comprising an index Equal or, failing that, immediately greater than that which they held at their original rank.
      Where the indicial gain resulting from their appointment is less than that which would have been obtained by a step-level advancement in their former Given to them, at the level of their new rank, a seniority equal to Seniority held at the level of their former rank multiplied by the relationship between the period of the new grade level and the level of the former grade level.

    • TITLE III: ADVANCEMENT Article 8

      Article 9


      At least 50 years of senior management at France Télécom, with at least four years' seniority in the 13th echelon, may be promoted, at the option, at the exceptional level of their grade, in The limit, each year, of 25 % of the workforce at the 13th echelon.
      When The number of promotions made in respect of one year is less than that limit, the difference between that limit and the number of promotions pronounced shall be added to the number of promotions which may be made in respect of the following year in Application of the above provisions.

      Article 10


      Can be promoted to the rank of second level executive of France Télécom, by the Way of a professional competition, the first-level executives of France Télécom Having reached at least the 6th echelon in their grade on the closing date of the candidature lists.

    • TITLE IV: MISCELLANEOUS Article 11


      The rules for the general organisation of competitions and professional examination provided for in Article 4, 5 and 10, the nature and programme of the tests and the composition of the juries shall be fixed by decision of the President of France Télécom.

      Article 12


      Staff members belonging to the body governed by This decree may be integrated without prior secondment in the peer body under the post office.
      This integration shall be delivered, at the request of the persons concerned, at equivalence of grade and level identity with conservation of Seniority, by decision of the President of La Poste, after the agreement of the President of France Télécom.
      The actual services performed in the grade of origin are assimilated to services performed in the degree of integration.

      Article 13


      Category A employees, or members of an equivalent level, who hold a grade whose starting index is at least equal to the index related to the first Interval of one of the ranks of the body governed by this Order may be seconded to one of these ranks.
      The detachment is pronounced at a grade level and at the level with an equal index or, failing that, immediately above that Held in the grade or employment of origin.

    • TITLE V: FINAL PROVISIONS Article 14


      First level and second-level executives of France Télécom governed by the decree of 25 March 1993 referred to above shall be integrated into the body governed by this decree at grade and step equivalent with retention of seniority acquired in the body, grade and step.

      Article 15


      Representatives of the members of the body to the joint administrative committee of the France Telecom executives are held in office until their term of office expires.

      Article 16


      The executives of France Télécom trainees at the effective date of this Decree shall be held on that date.

      Item 17


      The Provisions of the decree of 25 March 1993 referred to above are repealed as they concern the body of the executives of France Télécom.

      Article 18


      Minister of State, Minister of Economy, Finance and Industry, Minister of Public Service and State Reform, Minister Delegate to Industry and Secretary of State for Budget and Budget Reform Shall each be responsible for the execution of this Decree, which shall be Published in the Official Journal of the French Republic
