Order of July 25, 2007, allocating cases between the administrative sections of the Council of State

First Minister and the Minister of Justice, Minister of Justice,
Given the Code of Administrative Justice, including articles R. 123-3 and R. 123-6;
In light of Order No. 2007-991 of 25 May 2007 on the remit of the Minister of National Education;
In light of Decree No. 2007-992 of 25 May 2007 on the powers of the Minister for Housing and the City;
In light of Decree No. 2007-993 of 25 May 2007 on allocations The Minister of Agriculture and Fisheries;
In light of Decree No. 2007-994 of 25 May 2007 on the powers of the Minister for Culture and Communication, Government Spokesperson;
In light of Decree No. 2007-995 of 31 May 2007 concerning Minister of State, Minister of Ecology, Development and Sustainable development;
In light of Decree No. 2007-996 of 31 May 2007 on the remit of the Minister for the Economy, Finance and Employment;
In light of Decree No. 2007-997 of 31 May 2007 on the powers of the Minister of the Interior, Overseas and local authorities;
Given the decree n ° 2007-999 of 31 May 2007 on the powers of the Minister for Immigration, Integration, National Identity and Co-development;
Given the decree n ° 2007-1000 of 31 May 2007 relating to the duties of the Minister of Labour, Social Relations and Solidarity;
In light of Decree No. 2007-1001 of 31 May 2007 on the remit of the Minister for Higher Education and Research;
In light of Decree No. 2007-1002 of 31 May 2007 on the powers of the Minister of Health, of the Youth and sports;
In light of Decree No. 2007-1003 of 31 May 2007 on the powers of the Minister of the Budget, Public Accounts and the Public Service;
In the light of the decree of 18 June 2007 appointing the Prime Minister
Decree of 19 June 2007 concerning the composition of the Government;
In the opinion of the Vice-President of the State Council,

Article 1


Dependent cases are examined by the inside section:
-from the Prime Minister, except in relation to active solidarity against poverty;
-from the Minister of the Interior, Overseas and Territorial Communities;
-Minister of Immigration, Integration, Identity National and co-development;
-the Minister of Justice;
-the Minister of National Education; and
-the Minister of Higher Education and Research, except for space;
-the Minister Health, youth and sports, except for health;
-du Minister of Culture and Communication, except for protected areas.

Article 2


Examaged by the Dependent Business Finance Section:
-the Minister of Economy, Finance and Employment, with the exception of employment, vocational training, industry, electronic communications and jobs, new technologies, small and medium-sized enterprises, and Tourism;
-the Minister of Foreign and European Affairs;
-the Minister of Defence, with the exception of war veterans and war victims; and
-the Minister of the Budget, Public Accounts and the Office Public, except for the preparation of the Security Financing Act Social.

Article 3


The public works section examines the following cases:
-Minister of State, Minister of Ecology, Sustainable Development and Planning;
-Minister of Economy, Finance and Employment, with regard to industry, electronic communications and positions, news Technologies, small and medium-sized enterprises and tourism;
-the Minister of Higher Education and Research, as far as space is concerned;
-the Minister of Housing and City;
-the Minister of Agriculture and Fishing; and
-the Minister of Culture and Communication, in respect of Saved sectors.

Article 4


Dependent business is examined by the Social Section:
-the Prime Minister, with regard to active solidarity against poverty;
-the Minister of Economy, Finance and Employment, with regard to employment and vocational training;
-the Minister of Labour, Social relations and solidarity;
-the Minister of Defence, with respect to veterans and war victims;
-the Minister of Health, Youth and Sport, as it relates to health;
-du Minister of Budget, Public Accounts and the Public Service with respect to the preparation of The Social Security Financing Act.

Article 5


Notwithstanding the provisions of the preceding Articles:
1 ° State officials and agents of the State as well as state workers are examined by the finance section. The status cases concerning the territorial civil service are examined by the section of the interior; those concerning the hospital public service are examined by the social section. Pension cases are reviewed by the Finance Section.
Business in mutual and provident insurance transactions is reviewed by the Finance Section.
2 ° Are reviewed by the Financial Section. Social section dealing with social protection, social action, labour and employment, even if they are not directly related to the Minister of Labour, Social Relations and Solidarity, the Minister of Health, Youth and sports or the Minister of the Budget, Public Accounts and Public service.
3 ° Cases dependent on the Minister of the Interior, Overseas and Territorial Communities are, when they extend into an overseas community or in New Caledonia, legislation or Of a metropolitan regulation, examined by the section that has jurisdiction to know about this legislation or regulation under this Order.

The September 22 Order 2005 on the distribution of cases between the administrative sections of the Council of State is repealed.

Article 7


The Vice-President The Council of State is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
