Summary


After observing a deficit Accumulated EUR 34 million and a deficit of EUR 17 million over the last financial year (2002-2003) of the special social security system for the electricity and gas industries, the coordination committee for the Complementary mutual funds and social action proposes a series of measures allowing a return to an operating balance. All the trade union organisations in the electricity and gas industries agreed to call for an audit aimed at informing the social partners with a view to possible changes in the contribution structure. Closer to the industry's professional organizations. Pending decisions involving the recasting of the contribution structure, the Coordination Committee initially proposed, as a temporary measure, an increase in contributions up to 31-03-2005 in order to Balance the special social security system according to the change in the part of the deficit linked to the increase in technical expenses: - personal activity 3.786 %; - retired staff 1.959 %. After consultation with the social partners and discussions within the branch, the proposal has been transformed as follows: an exceptional and temporary contribution, in addition to the contributions provided for in Art. 23, paragraph 8 of the national Staff Regulations of the IEG. The rate of this contribution is as follows: -for the agents in operation, at 0.3 % for these agents and 0.3 % for the services, operations or undertakings; - for pensioners, 0.225 % for those pensioners and 0.3 % for the services, operations or Enterprises, for a period of one year from 01-07-2003 to 30-06-2004.

The Prime Minister,
On the report of the Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry, and the Minister of Health, Family and People Disabled,
In view of the Social Security Code, and in particular Article L. 711-1;
Given the national status of the personnel of the electric and gas industries, approved by Decree No. 46-1541 of 22 June 1946, as amended;
Given the Decree No. 97-345 of 11 April 1997 fixing the rate of contributions and the ceiling provided for in Article 23, Paragraph 8, of the national status of the personnel of the electricity and gas industries;
In view of the proposal of the Coordination Committee for complementary mutual funds and social action;
In the opinion of the representative organisations of the Employers in the electricity and gas industries;
In view of the opinion of the Supreme Council for Electricity and Gas dated June 24, 2003,

It is hereby established on an exceptional basis, in addition to the contributions provided for in Article 23 (8) of the national Staff Regulations Electricity and gas, a contribution based on the salaries defined in Article 9 (3) of that Staff Regulations and pensions, with a ceiling of 1.55 times that of the general social security scheme, paid as of 1 July 2003 and Until June 30, 2004.
The rate of this contribution is fixed:
-for active agents, 0.3 % for these agents and 0.3 % for services, operations or businesses;
-for pensioners, 0.225 % for those pensioners, and 0.3 % for services, Operations or undertakings.
This contribution shall be recovered under the conditions laid down in Article 23 (9) of the national Staff Regulations of the electricity and gas industries.
