Summary

The c of art. R. 532-3 (art. 8 of Decree 87-206) and R. 831-6 (art. 11 of Decree 88-568) of the Social Security Code is repealed; the 5th paragraph of Art. R. 532-3 and R. 831-6 of the same code are written; s. R. 532-4 (art. 8 of the decree 87-206) is thus amended: the 2 ° is repealed, the 3 ° becomes the 2 °; modification of the art. R. 532-7 (al. 3) (art. 8 of Decree 87-206).

The Prime Minister,
On the report of the Minister of the Family and Children, the Minister of Employment, Labour and Social Cohesion, the Minister of State, Minister for the Economy, Finance and Industry, and the Minister for Agriculture, Food, Fisheries and Rural Affairs,
Given the social security code, including books V and VIII;
Given the rural code;
In view of the opinion of the Board of the National Family Allowance Fund as of 2 March 2004;
The State Council (section Social) heard,

I. -The c of articles R. 532-3 and R. 831-6 of the Social Security Code is
. -The fifth paragraph of Articles R. 532-3 and R. 831-6 of the Code is worded
follows: Also considered are:
" 1 ° After applying the deductions corresponding to those referred to in the second subparagraph of Article 83 of the General Tax Code and the fourth paragraph of Article 158 (a) of Article 158 of the same Code, the daily allowance referred to in Article L. 2. 431-1;
" 2 ° Pensions or pensions for children exempt from income tax pursuant to Article 81 of the General Tax Code, except those corresponding to pensions or liquidated pensions before the 1st January 2004, the allocation of which is subject to the provisions of this Article shall be held by persons benefiting from the allocation as at 30 June 2005. "

Article R. 532-4 of the Social Security Code is thus modified:
I.-2 ° is repealed.
II. -The 3 ° becomes the 2 °.

In the third paragraph of Article R. 532-7 of the Social Security Code, the words: " The first day of the calendar month " Are replaced by the words: " On the first day of the second calendar month ".

The provisions of this Decree shall apply to benefits payable on the first day of the month which Follows its publication. However, the sixth paragraph of Articles R. 532-3 and R. 831-6 of the Code of Social Security, in the wording resulting from this Decree, applies only to benefits payable as from 1 July 2005.

Minister of State, Minister of Economy, Finance and Industry, Minister for Employment, Labour and Social Cohesion, Minister of Agriculture, Food, and Labour The Minister for Family and Children's Affairs, the Secretary of State for the Budget and Budget Reform and the Secretary of State for Housing shall each have responsibility for the implementation of this Decree, which shall be Published in the Official Journal of the French Republic.
