Order of 21 June 2004 for the approval of an organization for the implementation of Decree No. 2001-386 of 3 May 2001 as amended relating to equipment Transportable pressure

The Minister Delegate to Industry,
In light of the amended Order in Council dated January 18, 1943, Gas pressure;
In light of Decree No. 2001-386 of 3 May 2001 as amended on transportable pressure equipment and taken for the application of Article 2 of Decree No. 97-34 of 15 January 1997 on the deconcentration of decisions Individual administrative measures, and in particular Article 14 thereof;
Having regard to the amended Order of 11 March 1986 applying Article 3 of Directive 84 /525/EEC on seamless steel gas cylinders;
Seen the order of 11 March 1986 Amended implementing Article 3 of Directive 84 /526/EEC relating to Non-alloy aluminum and aluminum alloy seamless gas cylinders;
In light of the amended order of 11 March 1986 applying Article 3 of Directive 84 /527/EEC on non-alloy steel welded gas cylinders;
Vu The Order of 4 July 2001 concerning the classification and assessment of the conformity of transportable pressure equipment;
Having regard to the order of 3 May 2004 concerning the operation of pressure receptacles;
In view of the request presented By Air Liquide Inspections and Services (ALIS) dated October 17, 2003, completed 10 March and 26 May 2004;
In view of the opinion of the Central Commission for Pressure Devices (General Standing Section) dated 15 June 2004;
Considering that this body meets the requirements of the decree of 3 May 2001 as amended;
Sur Proposal by the Director of Regional Action and Small and Medium Industry,
Stop:

Item 1


Air Liquide Inspections and Services (ALIS), domiciled Coeur Défense, Tower A, La Défense 4, 110, esplanade Of General-de-Gaulle, 92931 Paris-La Défense Cedex, is registered from 1 July 2004 and until 30 June 2006 for:
1. Establish the conformity of existing transportable pressure receptacles manufactured in series, including their taps and other accessories used for transport, as defined in Article 6 of the aforementioned decree of 3 May 2001, provided that The conformity assessment of the type was carried out in advance by an authorised body by means of the conformity assessment procedure set out in Part II of Annex 2.
2. Perform periodic inspection, as defined in Article 12 (1) of the aforementioned Decree of 3 May 2001, of pressure receptacles Which have received the marking provided for in Article 10 and those which have been the subject of the conformity assessment referred to in Article 5 (2) of the aforementioned Decree, including that of their taps and other accessories used for the purpose of In accordance with the procedure set out in Part III of Annex 2 (Module 1).
3. Perform periodic inspection, as defined in Article 12 (2 °) of the aforementioned decree of 3 May 2001, of existing transportable pressure receptacles constructed in accordance with the provisions of the aforementioned decree of 18 January 1943 which do not Is subject to the reassessment of compliance referred to in section 6 of the above-noted Order in accordance with the procedure set out in Part III of Schedule 2 (Module 1).
4. Perform periodic inspection, as defined in Article 12 (4) of the aforementioned decree of 3 May 2001, of existing transportable pressure receptacles bearing the conformity marking provided for by the orders of 11 March 1986 modified in Application of the aforementioned decree of 18 January 1943 relating to gas cylinders of seamless steel, non-alloy aluminium and non-alloy welded aluminium alloy, respectively, in accordance with the procedure referred to in Part III of its Schedule 2 (Module 1).

Article 2


For activities related to this approval, ALIS is required to meet the following conditions:
1. Maintain accreditation with the French Accreditation Committee (COFRAC) or another equivalent accredited accreditation body as well as a documented system in accordance with NF EN 45004 for all procedures relating to the present Approval.
Any change in compliance with this requirement shall be reported to the Minister responsible for industry.
2. To lend itself to the monitoring activities that may be carried out by the administration officers responsible for the Control of transportable pressure equipment or a mandated person By the Minister responsible for industry, to verify compliance with the conditions of this Order, as well as its technical and regulatory
. Participate in the meetings organised at the initiative of the State to ensure national coordination between the French authorised and authorised bodies and also participate, as appropriate, in the coordination bodies set up at the level European, under the Transportable Pressure Equipment Directive.
4. Participate, as appropriate, in national and European standardisation work on transportable pressure equipment affected by this approval.
5. Implementing the interpretation provisions of the Directive on transportable pressure equipment, drawn up by the Commission and the Member States, notified to it by the Minister responsible for industry, and informing the manufacturers And the operators, on their request, of the existence of these provisions.
However, in the event that the agency does not feel that some of these provisions are not required, it will be up to the Agency to refer the matter to the Minister responsible for Industry.
6. Provide, on the request of the national authorities of a Member State of the European Union in charge of market surveillance, any information necessary for carrying out this activity, as well as, on their request, the services of the Commission Responsible for the management of safeguard clauses, all necessary information. This information is sent via the Minister responsible for industry or directly to the requesters with a copy to the Minister.
7. To show the separation of activities as a recognised organisation from those which it may otherwise have, whether in the field of advice, evaluation, testing, inspection or surveillance in the voluntary sector for the account A manufacturer, an operator or a payer, or for the application of national regulations other than those covered by the decree of 3 May 2001.

8. Without prejudice to the request for further information, the Minister responsible for industry shall submit an annual report on the activity carried out under this authorisation before 31 March of the year in question.
9. Notifies the Minister of Industry in advance of any changes to the liability insurance purchased to cover the risks inherent in the activity.
10. Notify the operator of any non-compliance of transportable pressure receptacles in service observed in the activities referred to in Article 1 above. Unless the operator takes action within one month, the organization shall notify the Regional Director of Industry, Research and Environment (DRIRE) of this non-compliance.
Information from the operator and the operator DRIRE is immediate if the non-compliance of transportable pressure receptacles is likely to seriously compromise the safety of persons.

Article 3


This approval may be Suspended, restricted or withdrawn in the event of a serious breach of the obligations laid down in the decree of 3 May 2001 referred to above or the conditions of Article 2 of this decree.

Article 4


The Director of Regional Action and Small and Medium Industry is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
