Order of July 9, 2002 declaring public utility the acquisitions and works necessary to achieve the deviation of the road Departmental 901 between " The St. Lawrence Barrière " And " La Nau ", on the territory of the communes of Allassac, Saint-Viance and Varetz (Corrèze)

The Prime Minister,
On the report of the Minister of the Interior, Internal security and local freedoms,
Due to the code of expropriation for public utility purposes;
In view of the road code, in particular Articles L. 152-1 and R. 152-2;
Given the rural code, in particular Articles L. 123-24 to L. 123-26 and L. 352-1;
In view of the general code of the local authorities, in particular Article L. 3211-1;
Given the environmental code, in particular Articles L. 123-1 to L. 123-16;
Given the master plan of the country of Brive approved on 29 November 2000;
In view of the Deliberation of the General Council of the Corrèze of 19 January 1999 adopting the choice of Alternative 2 A between " The Nau " In Saint-Viance and " The St. Lawrence Barrière " In Allassac and soliciting the undertaking of the expropriation procedure;
Having regard to the prefectural order of 16 November 2000 prescribing the initiation of an investigation concerning the deviation of RD 901 between " The St. Lawrence Barrière " And " The Nau " On the territory of the communes of Allassac, Saint-Viance and Varetz;
In view of the parts of the investigation to which it was carried out from 4 December 2000 to 12 January 2001 inclusive, together the unfavourable opinion of the Committee of Inquiry;
In view of the deliberation The General Council of the Corrèze of 15 October 2001 deciding to continue the procedure for the declaration of public utility of its project before the Conseil d' Etat;

Article 1

Procurement and work necessary for the realization of the deviation shall be declared as public utility Of RD 901 between " The St. Lawrence Barrière " And " La Nau ", on the territory of the communes of Allassac, Saint-Viance and Varetz, in accordance with the plan of 1/5 000 annexed to this Decree (1).

Article 2

The necessary expropriations must be completed within five years of the publication of this Order.

Item 3

The department, the book master, is kept To carry out the obligations arising from the application of Article L. 123-24 of the Rural Code.

Article 4

The Minister of The interior, internal security and local freedoms and the minister responsible for local freedoms shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal of the French Republic.
