Order of 28 June 2005 extending d ' an agreement entered into in the framework of the national collective agreement of direct advertising logistics companies (point 1611)

The Minister of Employment, Social Cohesion and Housing,
Having regard to Articles L. 133-1 and following of the Labour Code;
Having regard to the order of 28 April 1992 and the successive orders, In particular the decree of 21 March 2005 extending the national collective agreement of the direct advertising logistics undertakings of 19 November 1991 and of the texts which amended or supplemented it;
Having regard to the agreement of 7 December 2004 Relating to lifelong vocational training concluded within the framework of the abovementioned collective agreement;
In view of the request for extension by the signatory organisations;
In view of the opinion published in the Official Journal of 4 February 2005;
Given the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), delivered in session on 30 May 2005;

Item 1


Are made mandatory for all employers and employees included in the field Application of the national collective agreement of the direct advertising logistics undertakings of 19 November 1991, as the result of Amendment No 4 of 20 December 1996, as amended by Amendment No 5 of 22 October 1997, the provisions of The agreement of 7 December 2004 on lifelong vocational training concluded in the framework of The aforementioned national collective agreement, excluding the last paragraph of Article 9 (accompanying the undertakings in the preparation of their training plan) as contrary to the provisions of the last paragraph of Article R. 964-4 of the Labour Code, under which the management and information costs of registered joint collecting bodies may not exceed a ceiling fixed by the Minister responsible for vocational training.
The sixth paragraph of the Article 5 (the professionalization contract) is extended subject to The application of the provisions of the second subparagraph of Article L. 981-3 of the Labour Code.
The third paragraph of the paragraph Financial conditions for the remuneration of professional contracts " Article 5 (the contract of professionalisation) is extended subject to the application of the provisions of the last paragraph of Article L. 981-5 of the Labour Code.
The second point of Article 6 (development of Apprenticeship and the tutoral function) shall be extended subject to the application of the eleventh to sixteenth paragraphs of Article R. 964-16-1 (4 °) of the Labour Code.
The fifth paragraph of Article 6 (development of apprenticeship and Tutoral function) is extended subject to the application of the eleventh to sixteenth paragraphs of Article R. 964-16-1 (4 °) of the Labour Code.

Article 2


The extension of the effects and sanctions of the abovementioned Agreement shall be dated The publication of this Order for the remaining duration and the conditions laid down in that agreement.

Article 3


The Director Job relations is responsible for running the present Order, which will be published in the Official Journal of the French Republic.
