The President of the Republic,
On the report of the Prime Minister and the Minister for Foreign and European Affairs,
Having regard to Articles 52 to 55 of the Constitution;
In light of Decree No. 53-192 of 14 March 1953, as amended Concerning the ratification and publication of international commitments entered into by France,
Décrète:

Article 1


The Agreement in the form of an exchange of letters between the Government of the French Republic and the Council Swiss Federal Republic concerning the amendment of the Agreement on the Carriage of Persons and Goods by Road between Switzerland and France, signed in Paris on 20 November 1951, signed in Bern on 29 January 2007 and 1 February 2007, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign and European Affairs shall each have responsibility for the execution of this Decree, which shall be Published in the Official Journal of the French Republic.

UNDER EXCHANGE OF LETTERS BETWEEN THE GOVERNMENT OF THE FRENCH REPUBLIC AND THE COUNCIL FEDERAL SWITZERLAND CONCERNING THE MODIFICATION OF THE AGREEMENT ON TRANSPORTATION OF PERSONS AND GOODS BY ROAD BETWEEN SUISSE AND FRANCE

The Embassy of France presents its compliments to the Federal Department of Foreign Affairs and, referring to the discussions held between the French and Swiss delegations on the amendment of the Agreement The carriage of persons and goods by road between France and Switzerland, Signed in Paris on 20 November 1951, has the honour to communicate the following:
The Government of the French Republic proposes to the Swiss Federal Council to amend Article VI " General Provisions " The said Agreement as follows:
The first paragraph shall be replaced by the following:
All inland transport shall be strictly prohibited, with the exception of regular cross-border transport of persons by coach and Bus in the border area, governed by this Agreement:
1. Between two or more places in the territory of one or more Swiss cantons bordering on vehicles registered in France or in a country of the European Union;
2. Between two or more places in the territory of one or more French departments bordering on vehicles registered in Switzerland or in a country of the European
. :
1. For Switzerland, the cantons of Argovie, Basel-City, Basel-Country, Solothurn, Jura, Bern, Neuchâtel, Vaud, Geneva and Valais.
2. For France, the departments of the Haut-Rhin, the territory of Belfort, the Doubs, the Jura, the Ain and Haute-Savoie.
The competent Swiss and French authorities determine, by mutual agreement, the perimeters within which transport Border crossings are permitted (border area).
They ensure respect for the principles of reciprocity and equal treatment in market access.
The second Paragraph shall be replaced by the following:
For all matters not dealt with in this Agreement, the provisions of the laws and regulations of each Contracting Party shall remain reserved.
The third paragraph shall be replaced by the following:
The competent authorities are, on the French side, the Ministry of Transport, Equipment, Tourism and the Sea, Directorate-General for the Sea and Transport, and, on the Swiss side, the Federal Department of the Environment, Transport, Energy and Communication, Federal Transport Office.
The fourth and fifth paragraphs are unchanged.
If the Swiss Federal Council approves the above, this note and the Federal Department of Foreign affairs will be the Agreement between the two governments Concerning the amendment of the Agreement on the Carriage of Persons and Goods by Road between Switzerland and France, signed in Paris on 20 November 1951. This Agreement shall enter into force on the date of the Swiss answer
. The Embassy of France, which requests the Federal Department of Foreign Affairs to find, in the annex, the original credentials established on behalf of the Ambassador of France in Switzerland to sign this agreement in the form of an exchange of notes, seizes This opportunity to renew the assurances of its high regard.

The Department has the honour to communicate, on behalf of the Swiss Federal Council, that the Swiss Federal Council has approved the above.
The note from the Embassy of 29 January 2007 and the present reply thus constitute an Agreement between the Government of the Swiss Confederation and the Government of the French Republic, which enters into force today.
The Department takes this opportunity to renew to the Embassy the assurance of its high regard.
