Decree of 26 June 2003 extending the regional collective agreement (Languedoc-Roussillon) of construction workers concluded within the framework of the collective agreement of the workers of the enterprises of the Building subject to the decree of 1 March 1962 (enterprises occupying up to#039; to ten employees)

The Minister of Social Affairs, Labour and Solidarity and the Minister for Agriculture, Food, Fisheries and Rural Affairs,
In view of Articles L. 133-1 et seq. Of the Labour Code;
Seen the orders of 12 February 1991 and 15 December 1992 extending the National collective agreement of 8 October 1990 concerning the workers employed by the undertakings in the building covered by the decree of 1 March 1962 (i.e. occupying up to ten employees) and endorsements supplementing it;
Given the Convention Regional collective (Languedoc-Roussillon) of 28 January 2002;
Given the demand Extension presented by the signatory organisations;
Due to the opinions published in the Official Journal of 4 June and 6 August 2002;
Seen the opinions gathered during the survey;
Given the reasoned opinions of the National Commission for the Negotiation Collective (Sub-Committee on Conventions and Agreements), in its meetings of 20 March 2003 and 22 May 2003,

Item 1


Are made mandatory for all employers and employees included in the field Professional application of the national collective agreement of 8 October 1990 concerning workers employed by undertakings in the building covered by the former decree of 1 March 1962 (i.e. occupying up to ten employees) as completed By the Amendment No 1 of 17 March 1992, and in its own territorial scope, the Provisions of the regional collective agreement (Languedoc-Roussillon) of 28 January 2002, excluding:

-the first paragraph of the b (termination) of Article 3.1.5 (various provisions) of Title III referred to above as being contrary to Provisions of the fourth paragraph of Article L. 115-2 of the Labour Code Which the contract may terminate at the initiative of the employee in the event of graduation or the title of the technological education prepared;

The first indent of the fourth Paragraph of f (fitness sheet and medical examinations) of Article 3.1.5 above shall be extended subject to the application of the provisions of the first paragraph of Article L. 212-13 of the Labour Code.

Article 2


The extension of the effects and sanctions of the aforementioned regional collective agreement shall be made from the date of publication of this Order for the remainder of To run and the conditions laid down by the said regional collective agreement.
