Art. 41 of the Social Security Financing Act for 1999 (98-1194 of 23-12-1998) instituted an early cessation of activity, from the age of 50, for the benefit of persons who are victims of a professional disease caused by a recognised asbestos Under the general scheme. Art. 54 of the Social Security Financing Act for 2003 (2002-1487, 20-12-2002) extends this provision to recognised agricultural workers who are victims of occupational diseases caused by asbestos. The allowances for the early termination of employment of asbestos workers are the responsibility of a fund, devoid of legal personality, but with a supervisory board. In these circumstances, the Minister for Agriculture, Food, Fisheries and Rural Affairs and the agricultural social mutuality should be represented at the supervisory board (Art. 1). The allowances are paid in metropolitan France by the regional health insurance funds in respect of employees covered by the general scheme, but by the agricultural social insurance funds in respect of agricultural workers. Overseas, the general social security funds serve the benefit to all beneficiaries. Article 2 provides for the unity of procedure irrespective of the body serving the allowances. Modification of Art. 3 (last) and 10 of the aforementioned decree.

The Prime Minister,
On the report of the Minister of Social Affairs, Work and solidarity, the Minister of Economy, Finance and Industry, and the Minister of Agriculture, Food, Fisheries and Rural Affairs,
Given the Social Security Code;
Given the Labour Code;
Vu Act No. 98-1194 of 23 December 1998 on the financing of social security for 1999, in particular its amended Article 41;
In view of Act No. 2002-1487 of 20 December 2002 on the financing of social security for 2003, in particular Article 54;
Vu Decree No. 99-247 of 29 March 1999 on the allocation of early termination of employment Provided for in Article 41 of the Social Security Financing Act for 1999, as amended by Decree No. 2000-638 of 7 July 2000,
Article 10 of the decree of 29 March 1999 is amended as follows:
1 ° The third paragraph is replaced by the following provisions:
" 2 ° Four representatives of the State: ;
2 ° Following the sixth paragraph, the following paragraph is inserted:
" -a representative of the Minister responsible for agriculture; ;
3 ° After 3 ° is added a 4 ° worded as follows:
" 2 Incumbent members and two alternates appointed by joint decree of the Minister responsible for Social Security and the Minister responsible for agriculture on the proposal of the Central Administrative Council of the Agricultural Social Mutuality. "

The last paragraph of Article 3 of the decree of 29 March 1999 is replaced by the following provisions:
" For the application of the provisions of Articles 3 and 5 of this Decree to agricultural employees in the metropolitan departments, the funds of agricultural social mutuality shall exercise the powers conferred on the regional health insurance funds. In the overseas departments, the general social security funds shall exercise the powers conferred on the regional health insurance funds or the agricultural social insurance funds by this Decree. "
