Given Act No. 2003-47 of 17 January 2003 Salaries, working time and employment development, including Article 1;
In view of the opinion of the National Commission for Collective Bargaining dated 23 June 2003;
The Council of Ministers heard,
Describes:
As of July 1, 2003, The amount of the guaranteed minimum provided for in Article L. 141-8 of the Labour Code is fixed at 3 EUR in metropolitan France, in Saint-Pierre-et-Miquelon and in the overseas departments.
For the application of article L. 141-3 of the Labour Code, the reference index is the consumer price index, out of tobacco, of urban households whose head is a worker or employee of the month of May 2003 published in the Journal Official.
Employers who have paid salaries below the minimum wage set out in Article 1 above will be liable to the penalties laid down in Article R. 154-1 of the Labour Code in respect of the metropolis, And Article R. 881-1 of the Labour Code in respect of Saint Pierre and Miquelon and the overseas departments.
Prime Minister, Minister of Social Affairs, Labour and Solidarity, the Minister of Economy, Finance and Industry, the Minister of Agriculture, Food, Fisheries and Rural Affairs and the Minister for Overseas shall be responsible, as far as it is concerned, for the application of this Order, to be published in the Official Journal of the French Republic.
