Abstract


Application of Art. The Protocol to the Agreement on Cooperation and Customs Union between the European Economic Community and San Marino, signed in Brussels on 30 October 1997, is intended to enable Austria, Finland and Sweden to To become parties to the cooperation and customs union agreement signed in 1991 between San Marino and the European Economic Community, and to establish in the Finnish and Swedish languages the text of the agreement. Customs between the European Community and the Republic of San Marino. All goods produced within the Community or in San Marino are covered by this agreement with the exception of the products covered by the ECSC Treaty. For its part, the Republic of San Marino undertakes to apply the Common Customs Tariff, the Community customs provisions, the rules of trade policy and the Community rules on customs to third countries. The Agreement prohibits any discrimination on grounds of Sanmarinese nationality in relation to nationals of the European Union in respect of conditions of work and remuneration as well as in the field Considered priority industry, services, environment, tourism, Communication, information and culture. A cooperation committee is responsible for managing the agreement and ensuring its proper functioning. This protocol does not affect the commitments entered into by France under the agreement on cooperation and customs union between the Economic Community European and the Republic of Saint-Marin.This Protocol entered into force on April 1, 2002.

The President of the Republic,
On the report of the Prime Minister and the Minister for Foreign Affairs,
Having regard to Articles 52 to 55 of the Constitution;
In light of the amended Decree No. 53-192 of 14 March 1953 concerning the Ratification and publication of the international commitments entered into by France;
Given the decree n ° 2003-463 of 19 May 2003 on the publication of the agreement Cooperation and customs union between the European Economic Community and the Republic of San Marino, done in Brussels on 16 December 1991,
Décrète:

Article 1


The Protocol to the Cooperation and Customs Union Agreement between the European Economic Community and the Republic of San Marino following the accession of the Republic of Austria, the Republic of Finland and the Kingdom of Sweden to the European Union, done in Brussels on 30 October 1997, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal of the French Republic.

In view of the agreement on cooperation and customs union between the European Economic Community and the Republic of San Marino Signed in Brussels on 16 December 1991, hereinafter referred to " Agreement " ;
Whereas the Republic of Austria, the Republic of Finland and the Kingdom of Sweden joined the European Union on 1 January 1995,
agreed as follows:


Article 1


The Republic of Austria, the Republic of Finland and the Kingdom of Sweden become Contracting Parties to the Agreement.


Article 2


The texts of the Agreement, written in Finnish and Swedish, shall be authentic under the same conditions as the original text and shall be annexed to this Protocol.


Article 3


This Protocol shall be approved by Contracting Parties in accordance with their own procedures. It shall enter into force on the first day of the first month following the notification by the Contracting Parties of the completion of these procedures.


Article 4


This Protocol shall be drawn up in two Copies in the Danish, Dutch, English, Finnish, French, German, Greek, Italian, Dutch, Portuguese and Swedish languages, each of these texts being equally authentic.

JOINT DECLARATION


The Council of the European Union and the representatives of the governments of the Member States meeting within the Council and the Republic of San Marino note that the cooperation and union agreement Customs between the European Economic Community and the Republic of San Marino, of 16 December 1991, was signed before the last enlargement of the European Union and, consequently, it was necessary to negotiate an adaptation protocol, To allow the extension of the agreement to the new Member States, signed Today.
