Décrète:
Protocol amending Article 50 (a) of the Convention on Civil Aviation Signed in Montreal on October 26, 1990, will be published in the Official Journal of the French Republic.
The First Minister and the Minister for Foreign and European Affairs are responsible, each As regards the execution of this Decree, which will be published in the Official Journal of the French Republic.
P R O T O C O L E
PORTANT AMENDMENT TO ARTICLE 50 (a) OF THE CONVENTION ON THE INTERNATIONAL CIVIL AVIATION CONVENTION
The Assembly of the International Civil Aviation Organization met in Montreal on October 25 1990, at its twenty-eighth session (extraordinary),
Having taken An act of the desire of a large number of Contracting States to increase the number of members of the Council in order to ensure a better balance by means of a broader representation of the Contracting States,
Having considered that it was appropriate to bring Thirty-three to thirty-six the number of members of this body,
Having considered it necessary to amend the Convention on International Civil Aviation made at Chicago on the seventh day of December 1944,
1. Approves, under the provisions of article 94 (a) of the Convention, the following draft amendment to the Convention:
" Amend the second sentence of paragraph (a) of Article 50 of the Convention by replacing the words "thirty-three with" thirty-six. ;
2. Set to one hundred and eight the number of Contracting States whose ratification is necessary for the entry into force of the proposed amendment, in accordance with the provisions of Article 94 (a) of that Convention;
3. Decides that the Secretary-General of the International Civil Aviation Organization shall establish in the English, French, Spanish and Russian languages, each of which shall be equally authentic, a protocol concerning the above-mentioned amendment including the Provisions below:
(a) The Protocol shall be signed by the President and the Secretary-General of the Assembly.
(b) It shall be subject to ratification by any State which has ratified or acceded to the Convention on International Civil
. Instruments of ratification shall be deposited with the International Civil Aviation Organization.
(d) The Protocol shall enter into force on the day of the deposit of the one hundred and eighth instrument of ratification in respect of the States that have ratified
. The Secretary-General shall immediately notify all Contracting States of the date of the Deposit of each instrument of ratification of the Protocol.
(f) The Secretary-General shall immediately notify all States Parties to the said Convention of the date on which the said Protocol enters into force
In respect of any Contracting State which has ratified it after the said date, as soon as that State has deposited its instrument of ratification with the International Civil Aviation Organisation.
Accordingly, in accordance with the above decision Of the Assembly, this Protocol has been prepared by the Secretary-General
In witness whereof, the President and the Secretary-General of the twenty-eighth (extraordinary) session of the Assembly of the International Civil Aviation Organization, duly authorized to that effect by the Assembly, have Their signature to this Protocol.
Done at Montréal on the twenty-sixth day of October of the year thousand nine hundred and ninety, in a single document in the English, French, Spanish and Russian languages, each of the texts being equally authentic. This Protocol shall be deposited in the archives of the International Civil Aviation Organization and certified copies shall be transmitted by the Secretary-General of the Organization to all States party to the Convention relating to International Civil Aviation in Chicago on the 7th day of December 1944.
