    The Prime Minister,
    On the report of the Minister of Employment, Labour and Social Cohesion,
    Given the Social Action and Family Code, including the Articles L. 411-1 to L. 411-6;
    In view of the code of education, in particular Articles L. 335-5 and L. 335-6;
    In view of Act No. 2000-321 of 12 April 2000 on the rights of citizens in their Relations with the administrations, in particular Article 21;
    Having regard to Decree No 80-334 of 6 May 1980 on the training of social service assistants;
    Having regard to Decree No. 2002-615 of 26 April 2002 taken for the application of Article L. 900-1 of the Code of work and articles L. 335-5 and L. 335-6 of the code of education on validation of the experience for the issue of professional certification;
    In view of the opinion of the Professional Advisory Committee on Labour Social intervention as of 2 October 2003;

    The social service assistant state diploma mentioned in the first paragraph of Article L. 411-1 above of the Code of Social Action and Families Demonstrates the skills required to carry out social, individual or collective interventions to improve the living conditions of individuals and families through a comprehensive approach and social support.

    Candidates for training preparing for the State diploma of social service assistant must justify diplomas at least equal to level IV of the Convention Interdepartmental training levels or an equivalent title. They are the subject of selection by the training institutions. An order of the Minister responsible for social affairs shall determine the conditions of application of this Article.

    The regional prefect appoints the diploma jury, which, in accordance with the provisions of the I of article L. 335-5 of the code of education, includes:
    -the Regional Director of Health and Social Affairs or his representative, the chairman of the jury;
    -trainers from training institutions preparing for the State diploma of social service assistant;
    -representatives of Decentralised services of the State, public authorities, qualified persons in the field of social action or teachers of higher education;
    -for a quarter of its members, qualified representatives of the sector Professional, half employers, half social service assistants Exercise.

    The social service assistant state diploma is issued by the region prefect.

    Training preparing for the State diploma of social service assistant shall be provided by public or private institutions approved under the conditions laid down in Article L. 451-1 of the Code of Social action and families.
    Approval is given on the basis of the qualifications of the supervisory and training staff, the educational project and the relevant teaching methods, as well as the conditions for the selection of candidates to the Training referred to in Article 2.

    Article 9
    Nationals of a Member State of the European Community and of the States Parties to the Agreement on the European Economic Area not holding a French State diploma as a social service assistant who Wish to practice in France the profession of assistant to Social service must obtain a certificate of capacity to be issued by the minister responsible for social affairs.
    A decree of the minister responsible for social affairs sets out the procedures for the presentation of the request for proof of capacity To be exercised, in particular the composition of the file accompanying this application. Upon receipt of the complete file of the person concerned, a receipt shall be issued to the person concerned.
    The certificate of capacity to be exercised shall be issued when the conditions laid down in paragraphs 2 to 6 of Article L. 411-1 of the Code of Action are satisfied
    , in the cases provided for in the seventh paragraph of the same article, the grant of the proof of capacity to exercise shall be subject to the verification of the applicant's capacity for the exercise of the profession of assistant Of social service in France.
    This check is made at the choice of the applicant
    a) Either by an aptitude test;
    (b) On the basis of an adaptation period.
    An order of the Minister responsible for social affairs sets out the conditions of organisation and the manner in which the aptitude test is to be awarded, as well as the Composition of the selection board to assess it. It also lays down the conditions for the validation of the adaptation traineeship.
    The decision to certify the ability to practice the profession or to make this exercise conditional on the aptitude test or the adaptation period mentioned above is taken by the Minister for Social Affairs. That decision must be reasoned. It must take place no later than four months from the date of receipt.
    In the event of success in the event of aptitude or validation of the adaptation period, the Minister responsible for social affairs shall issue the certificate of Ability to exercise under the first subparagraph.

    Article 11

    Article 12
    Nationals of states other than those Referred to in Article 9 above, holders of a diploma in social service who wish to practice in France the profession of social service assistant may be authorised by the regional prefect to undergo an adaptation period in order to obtain the State degree.

    Approvals issued pursuant to Article 4 of Decree No 80-334 of May 6, 1980, as amended, shall cease to have effect on the date of their renewal in accordance with the provisions of Article 8, and to the Later than June 30, 2007.

    Article 14
    Training prior to the date of entry into force of this Decree, as well as the arrangements for the grant of the corresponding diplomas, shall remain subject to the provisions of the Decree of 6 May 1980.

    Subject to the provisions of sections 13 and 14 of this Order, the amended Order of May 6, 1980 is repealed
    Decree No. 66-922 of 9 December 1966 on the exercise of the profession of assistant and auxiliary social service is repealed.

    Minister of Employment, work and social cohesion and the Minister responsible for the fight against precariousness and exclusion shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal of the Republic French.
