On the report of the Prime Minister, the Minister of National Education, Higher Education and Research and the Minister of Health and solidarity,

In the light of Decree No. 85-733 of 17 July 1985 on the masters of conferences and professors of the associated or invited universities, as amended by Decree No. 91-266 of 6 March 1991, by Decree No. 92-709 of 23 July 1992 and Decree No. 2002-1069 of 6 August 2002;
In the light of Decree No. 91-267 of 6 March 1991 on associated or invited teachers in certain higher education institutions reporting to the Minister responsible for education Higher, as amended by Decree No. 2002-1069 of 6 August 2002;

Describes:

  • TITLE I: PERMANENT PROVISIONS Article 1


    Article 1 of the decree of 24 February 1984 referred to above is thus amended:

    " (a) The body of teachers of hospital-based practitioners;

    " (d) The body of the lecturers of the university-medical practitioners of pharmaceutical disciplines. "

    Article 22

    Item 34


    Section 71-1 of the Order is replaced by the following:
    " Art. 71-1. -Professors of hospital-based practitioners and professors of hospital-based medical practitioners of pharmaceutical disciplines eligible for retirement may be awarded the title of professor emeritus for their academic functions By decision of the Council of the Training and Research Training Unit restricted to teachers, taken by an absolute majority of the members comprising this training.   • TITLE II: TRANSITIONAL PROVISIONS Article 35


    For a period of three years from Publication of this Decree, may be integrated, upon request, in the bodies of the lecturers of the university-medical practitioners of pharmaceutical disciplines and of the professors of the hospital-based university-practitioners of the Pharmaceutical disciplines, by direct integration, university professors and lecturers governed by the decree of 6 June 1984 referred to above which, on the date of publication of this Decree, also have the quality of A hospital practitioner governed by sections R. 6152-1 to R. 6152-99 of the Public Health Code or a part-time hospital practitioner governed by sections R. 6152-201 to R. 6152-277 of the Public Health Code.

    Article 36


    For a period of three years from the date of publication of this Decree, may be integrated, upon request, into the bodies of the masters of Conferences of hospital-medical practitioners of pharmaceutical disciplines and professors of hospital-based pharmaceutical practitioners of pharmaceutical disciplines, after advice of a national integration commission:
    1 ° The masters of Conferences and professors of universities governed by the decree of 6 June 1984 referred to above, as well as the assistants of higher education falling within the above-mentioned decree of 8 March 1999 which have been entered on the list of Functions of a hospital practitioner provided for in section R. 6152-7 of the Public Health Code, or who, as of the date of publication of this Order, shall perform one of the following hospital
    : Public health institutions governed by Articles R. 6152-401 to R. 6152-420 of the Public Health Code;
    -hospital assistant governed by Articles R. 6152-501 to R. 6152-537 of the Public Health Code;
    -attached practitioner or Associated practitioner of public health institutions, governed by Articles R. 6152-601 to R. 6152-634 of the Public Health Code;
    2 ° Hospital practitioners governed by Articles R. 6152-1 to R. 6152-99 of the Code of Public Health, Part-time hospital practitioners governed by Articles R. 6152-201 to R. 6152-277 of the Public Health Code which have been entered on the list of qualifications for the functions of a lecturer or on the list of qualifications Functions of professor of universities provided for in Articles 22 and 43 of the Decree of 6 June 1984 referred to above, or which, on the date of publication of this Decree, carry out one of the following teaching functions:
    -lecturer Governed by the decree of 17 July 1985 referred to above;
    -associate teacher whose duties correspond, in the institution, to those of the lecturers, governed by the decree of 6 March 1991 referred to above;
    -professor of Associated universities governed by the decree of 17 July 1985 referred to above;
    -associate professor whose duties correspond, in the institution, to those of the professors of the universities governed by the decree of 6 March 1991 referred to above.

    Article 37


    Applications for the integration of the agents referred to in Articles 35 and 36 of this Decree shall be submitted within a period of Three months after the publication of this Order.

    Article 38


    The composition, powers and rules of the The National Integration Commission shall be established by order of the Minister for Higher Education and the Minister responsible for Health.

    Article 39


    An order of the Minister responsible for higher education, the Minister responsible for health and the Minister responsible for the budget shall determine, each year, the number of posts which may be filled in application of the Sections 35 and 36 of this Order. When, in the same hospital and university centre and for the same discipline, several persons are likely to occupy the same vacant position, the position is proposed as a priority according to the following criteria:
    1. In accordance with Article 35 of this Decree, according to their seniority as a teacher-researcher when they previously had the status of a hospital practitioner, or their seniority as a hospital practitioner When they had previously been a teacher-researcher;
    2 ° For employees integrated under Article 36 of this Decree, depending on their seniority as a teacher-researcher or as a practitioner Full-or part-time hospital.

    Article 40


    University professors and non-class lecturers Governed by the decree of 6 June 1984 referred to above, integrated in application of the provisions of Article 35 and of the 1 ° of Article 36 of this Decree shall be reclassified in the bodies created by this Decree at grade and grade equivalency with Retention of seniority acquired in their old situation.
    By way of derogation from the provisions of Article 38 of Decree No 84-135 of 24 February 1984 referred to above, employees integrated under Article 35 of the This Decree shall collect non-withheld hospital emoluments, corresponding to 60 % of the emoluments provided for in Article R. 6152-23 of the Code of Public Health of which they were entitled in their former situation
    Hospital practitioners governed by Articles R. 6152-1 to R. 6152-99 of the Public Health Code and the part-time hospital practitioners governed by Articles R. 6152-201 to R. 6152-277 of the Code of Public Health, integrated into the application of 2 ° Article 36 of this Decree shall be reclassified in their new body under the conditions laid down in the decree of 26 April 1985 referred to above.

    Article 41


    For the initial constitution of the first class of the body of the lecturers of the university-medical practitioners of pharmaceutical disciplines established by this Decree, shall be added a first, a Two years, two years, two years, ten months and two years ten months.

    Article 42


    Personnel who can be integrated into Application of Articles 35 and 36 of this Decree shall receive a proposal for reclassification. As from the date of receipt thereof, they shall have a period of two months to accept their reclassification and appointment to the bodies created by this Decree.

    Article 43


    Integration is delivered by a decree of ministers responsible for higher education and health. That order must be taken within eight months of the date on which the person concerned has applied for the abovementioned scheme, extended up to 13 months when the opinion of the National Integration Commission is required.

    Article 44


    The Prime Minister, the Minister of Economy, Finance and Industry, the Minister of National Education, Higher education and research, the Minister of Health and Solidarity, the Minister of the Public Service and the Minister for Higher Education and Research are responsible, each as far as it is concerned, for The application of this Order, which will be published in the Official Journal of the French Republic
