Order of April 28, 2005, relating to individual substitutable volumes for certain controlled appellations of origin of the 2004 harvest

The Minister of Finance and Industry, the Minister of Agriculture, Food, Fishing and Rural Affairs, the Minister of Small and Medium Enterprises, Trade, Handicrafts, Liberal Professions and Consumer Affairs and the Minister Delegate to Budget and Budget Reform, Government Spokesperson,

Given the proposal of the National Wine and Life Committee of the National Institute of Appellations of Origin on September 17, 2004 and November 3 and 4, 2004,

Article 1


For the 2004 harvest for all controlled appellations of origin (AOC) of the Gironde department, with the exception Designations " Cadillac, " Let's hope, " Loupiac "," Sainte-Croix-du-Mont ", any producer may, in his declaration of harvest, claim as a controlled appellation of origin an individual substituted volume, called" VSI ", greater than the maximum allowable volume for the current year, but not exceeding the expected performance in the third paragraph of article R. 641-76 of the Rural Code.

Article 2


In respect of the 2004 harvest for the controlled appellations of origin cited below, any producer may, in his declaration of harvesting, claim as a controlled appellation of origin A " VSI " Exceeds the maximum volume allowed for the current year but contained within the limits as set out below:
-for the controlled appellation of origin " Chinon ", within the 5 hl/ha limit beyond the maximum volume allowed for the current year;
-for controlled appellations of origin" Beaujolais "," Beaujolais Villages "," Upper Beaujolais "," Beaujolais " Followed by the name of the original municipality, " Brouilly "," Chénas "," Surgery "," Côte de Brouilly "," Fleurie "," Juliénas "," Morgon "," Windmill "," Regdenied " And " Saint-Amour ", within the limit of 5 hl/ha beyond this maximum permissible volume for the current year;
-for controlled appellations of origin" Bourgogne Vézelay "," Pouilly Fuissé "," Pouilly Fuissé " + climates, within the 5 hl/ha limit beyond the maximum volume allowed for the current year;
-for the controlled appellation of origin " Vacqueyras ", within the limit of 2 hl/ha beyond the maximum volume allowed for the current year;
-for the controlled appellation of origin" Côtes du Ventoux ", and for red and rosé wines of the appellation of origin controlled" Côtes du Rhône Villages " Not followed by a common name, within the limit of 4 hl/ha beyond the maximum volume allowed for the current year;
-for red and rosé wines of the controlled appellation of origin " Côtes du Rhône ", within the limit of 6 hl/ha beyond the maximum volume allowed for the current year;
-for the controlled appellation of origin" Côtes du Luberon ", within the limit of 8 hl/ha beyond the maximum volume allowed for the current year.

Article 3

Article 4


The right to a controlled appellation of origin (AOC) can be granted to " VSI " By the services of the National Institute of Appellations of Origin, provided that:
-the conditions for the production of all wines produced in the holding for which the appellation of origin is claimed were Verified;
-the individual substitutable volume has successfully undergone the analytical and organoleptic examinations provided for in Articles R. 641-94 to R. 641-98 of the Rural Code at the same time and under the same conditions as the maximum permissible volume;
- The producer destroys by distillation a volume of wine equivalent to the same appellation and the same colour of previous vintage, produced on the same operation, before 31 July 2005.

Article 5


The certificate of approval provided for in Article R. 641-94 of the Rural Code shall be issued to the producer only once for the individual replacement volume after Presentation to the services of the INAO, no later than 31 July 2005, of proof of the destruction provided for in the fourth paragraph of Article 4 of this Order. The proof is hereby established:
-the accompanying document to the distillery of the volumes in question. In the topic " Product Designation " Of this document, the vintage of the AOC distilled appears immediately after the mention " VSI " ;
-the distillation certificate for wines established by the distiller.

Article 6


In case of non-compliance with all or part of the Provisions of this Order, the quantities claimed under the individual substitutable volume shall be sent to distillation under the conditions laid down in Article R. 641-80 of the Rural Code.

Article 7


The Director of Economic and International Policy, the Director General of Competition, Consumer and Fraud Prevention Director General of Customs and Indirect Rights shall be responsible for the execution of this Order, each of which shall be published in the Official Journal of the French Republic.
