The President of the Republic,
On the Prime Minister's Report Minister for Foreign Affairs,
Having regard to Articles 52 to 55 of the Constitution;
In view of Act No. 2002-1006 of 19 July 2002 authorising the ratification of the London Convention on Food Aid;
In the light of Decree No. 53-192 of 14 March 1953 amended on the ratification and publication of international commitments entered into by France,
Décrète:

Article 1


The Food Aid Convention, made in London on 13 April 1999, will be published in the Official Journal of the French Republic.

Article 2


The Prime Minister and the Minister for Foreign Affairs shall each have responsibility for the execution of this Decree, which shall be published in the Official Journal of the French Republic.

FOOD AID CONVENTION
PREAMBLE


Parties to this Convention,
Having reviewed the Food Aid Convention of 1995 and its objective of providing at least 10 million tonnes of food aid each year in the form of cereals Human consumption and wish to reiterate their commitment to maintain the international cooperation effort on food aid between them;
Recalling the Declaration on World Food Security and the Summit Action Plan World Food Programme adopted in Rome in 1996, including the commitment to ensure food security for all and to maintain a permanent effort to eradicate hunger;
Wishing to strengthen the capacity of the international community to Respond to food emergency situations and improve global food security through food aid assurance, regardless of world food prices and supply fluctuations;
Recalling that, In their decision in Marrakesh in 1994 on measures relating to the least developed countries and net food-importing developing countries, the ministers of the WTO member countries agreed to review the level of aid Food aid convention and in accordance with the recommendations developed subsequently at the 1996 Singapore Ministerial Conference;
Recognising that beneficiary countries and members have their Specific food aid policies and related issues and the ultimate goal of food aid is the elimination of the need for food aid itself;
Improving the effectiveness and quality of food aid Food aid as an instrument in support of food security in developing countries, in particular to reduce the poverty and hunger of the most vulnerable groups, and to strengthen the coordination and cooperation of members in the Food aid,
agreed as follows:


First Part
OBJECTIVES AND DEFINITIONS
Article I
Objectives


This Convention has the objectives of contributing to Global food security and enhancing the capacity of the international community to respond to food emergencies and other food needs in developing countries by:
a) Ensuring the availability of adequate levels Food aid on a predictable basis, in accordance with the provisions of this Convention;
(b) Encouraging members to ensure that the food aid provided is particularly aimed at reducing the poverty and hunger of the groups most Vulnerable and compatible with the agricultural development of these countries;
c) Including principles to optimize the impact, effectiveness and quality of food aid provided in support of food security, and,
d) Framework for cooperation, coordination and exchange of information among members on food aid issues, in order to improve the effectiveness of all aspects of food aid operations and increased compatibility between Food aid and other policy instruments.


Article II
Definitions


a) Under this Convention, unless the context otherwise requires:
i) " Caf " Means cost, insurance and freight;
ii) The term " Commitment " Means the minimum amount of food aid to be provided annually by a member under Article III e;
(iii) The " Committee " Means the Committee on Food Aid referred to in Article XV;
iv) The term " Contribution " Means the amount of food aid provided and notified to the Committee annually by a member, in accordance with the provisions of this Convention;
(v) The term " Convention " Means the 1999 Food Aid Convention;
(vi) The acronym " CAD " Means the OECD Development Assistance Committee;
vii) The term " Developing countries " Means any country or territory eligible to receive food aid under Article VII;
(viii) The expression " Eligible product " Means a product referred to in Article IV which may be supplied as food aid by a member as its contribution under this Convention;
ix) The " Executive Director " Designates the Executive Director of the International Grains Council;
x) The abbreviation " Fob " Means free on board;
xi) The terms " Food products " Or " Food aid " Include, where appropriate, seeds of food crops;
xii) The term " Member " Means a party to this Convention;
(xiii) The term " Micronutrients " Means the vitamins and minerals used to fortify or supplement the food aid products which may, according to Article IV (c), be taken into account as a contribution by a member;
xiv) The abbreviation " OCDE " Refers to the Organisation for Economic Co-operation and Development;
xv) First transformation products " Include:
-cereal flours;
-groats and meal;
-hulled, pearled, crushed, flattened, flattened (including flakes) except peeled, glazed, polished or broken rice;
-cereal sprouts, Even in flour;
-bulgur;
and
-any other similar products that the Committee may decide;
xvi) " Second transformation products " Include:
-macaroni, spaghetti, and like products;
and
-any other product, the manufacturing of which requires the use of a first-transformation product, which the Committee may decide;
xvii) The " Rice " Includes peeled, glazed, polished or broken rice;
xviii) The " Secretariat " Designates the secretariat of the International Grains Council;
xix) Tonne " Means a metric tonne of 1000 kilograms;
xx) The " Transportation and other operational costs " Which are listed in Annex A shall mean a cost associated with a food aid operation and incurred beyond the fob position or, in the case of local purchases, beyond the place of purchase, likely to be taken into account in whole or in part in the Member contribution;
xxi) The term " Value " Means the undertaking of a member in a convertible currency;
xxii) The expression " Wheat equivalent " Means the amount of a member's undertaking or contribution, as assessed under Article V;
xxiii) The abbreviation " OMC " Means the World Trade Organization;
xxiv) The term " Year " Means, unless otherwise specified, the period from 1 July to 30 June.
(b) Any reference in this Convention to a " Government " Or " Governments " Or a " Member " Is also deemed to be of interest to the European Community (hereinafter referred to as the EC). Second Part
CONTRIBUTIONS AND NEEDS
Article III
Quantities and quality


a) Members agreed to provide developing countries with food aid or cash equivalent at the height of the amount Minimum annual specified in paragraph e below (hereinafter referred to as " Commitment ").
(b) The commitment of each member shall be expressed either in tonnes of wheat equivalent or in value, or a combination of tonnage and value. Members who express their commitment in value are also required to specify a guaranteed annual tonnage.
(c) In the case of members expressing their commitment in value or in a combination of tonnage and value, the value may Understand transportation costs and other operational costs associated with food aid operations.

f) Transport and other operational costs, when taken in Account in the commitment of a member, must be incurred in the context of a food aid operation itself authorized to be taken into account in the engagement of a member.

h) Any member who has acceded to the present Convention under paragraph b of Article XXIII shall be deemed to be included in paragraph e of this Article, with its commitment.
i) The commitment of a new member referred to in paragraph h of this Article shall not be less than 20 000 tonnes Or to an appropriate value approved by the Committee. This undertaking is in principle applicable in full in the first year in which the country is deemed to accede to the Convention in the eyes of the Committee. However, in order to facilitate the accession of Governments other than those referred to in paragraph e of this Article, the Committee may accept that the appointment of a new member shall be phased in over a period of not more than three years, Provided that the undertaking is at least 10 000 tonnes or an appropriate value in the first year of accession and increases by at least 5 000 tonnes per year or an appropriate value in each subsequent year.
j) All Products supplied as food aid must meet international quality standards, be compatible with the diets and nutritional requirements of the beneficiaries and, with the exception of seeds, be specific to the Human consumption.


Article IV
Products


a) The following products are eligible as food aid under this Convention, subject to the relevant rules under the Rules of procedure:
i) Cereals (wheat, barley, corn, millet, oats, rye, sorghum or triticale) or rice;
ii) Grain products or first or second processing rice products;
iii) Legumes ;
iv) Edible oil;
v) Edible tubers (cassava, round potatoes, sweet potatoes, yams, taro), when supplied in triangular transactions or local purchases;
vi) Powder of Skimmed milk;
vii) Sugar;
viii) Seeds of eligible products; and
ix) Within the limits of paragraph b below, products that fall within the traditional diet of vulnerable groups or who enter Programmes of nutritional supplements which satisfy the conditions referred to in paragraph j of Article III of this Convention.
(b) The amount of food aid provided by a member to honour its commitment in a year In the form of:
i) All products referred to in paragraph (a) (vi) to (viii) of this Article shall not cumulatively exceed 15 % and no single category of such products shall exceed 7 % of its Commitment, not to mention transport costs and other operational costs;
(ii) All products referred to in subparagraph (a) (ix) of this Article shall not cumulatively exceed 5 % and none of these products individually May exceed 3 % of its commitment, excluding transport and other operational costs;
(iii) In the case of commitments expressed in terms of both tonnage and value, the percentages stipulated in subparagraphs (i) and (ii) above Will be calculated separately in terms of tonnage on the one hand and value on the other hand, excluding transportation and other operational costs.
c) As part of their commitment, members can provide micronutrients in Association with eligible products. They are encouraged to provide, where appropriate, fortified food aid products, particularly in emergency situations and targeted development projects.


Article V
Equivalence


a) Contributions are accounted for in terms of their wheat equivalent as follows:
i) Cereals suitable for human consumption equivalent to wheat;
ii) Rice contributions are determined by Relationship between the international price on the export of rice and wheat, in accordance with the rules laid down in the rules of procedure;
(iii) Equivalence of the first or second processing products of cereals or rice is Determined according to their respective levels of cereals or rice, in accordance with the rules laid down in the rules of procedure;

d) Cash contributions for the purchase of products Eligible food aid shall be evaluated in accordance with the wheat equivalent of these products or the prices of wheat on the international market, in accordance with the methods prescribed in the rules of procedure.


Article VI
Report or credit


a) Each member shall ensure that operations on his or her food aid commitment for a given year are, to the greatest extent possible, carried out in the course of The year indicated.
(b) If a member is unable to provide the quantity stipulated in paragraph e of Article III in a given year, he shall notify the Committee as soon as possible and, in all cases, at the latest Of the first session following the end of the year in question. Article VII
Recipient Countries


a) Under This Convention may be provided for food aid to the developing countries and territories listed in Annex B, namely:
i) Least developed countries;
ii) Other low-income countries;
iii) Countries to Intermediate income of the lower and other countries referred to in the WTO list of net food-importing developing countries at the time of negotiation of this Convention, when they are aware of emergencies International food or financial crises that induce food emergencies or when food aid operations target vulnerable groups.
(b) For the purposes of the preceding paragraph, any change The DAC list of developing countries and territories set out in Annex B to c shall also apply to the list of eligible beneficiaries under this Convention.

Article VIII
Needs


a) Food aid should only be provided when it Is the most effective and appropriate means of assistance.
b) Food aid must be based on a needs assessment by the recipient and the members, within the framework of their respective policies, and must be aimed at Improving food security in recipient countries. In responding to these needs, members must ensure that the specific nutritional needs of women and children are met.
c) Food aid for free distribution must target vulnerable groups.
d) Supply Food aid in emergency situations must take particular account of the rehabilitation and longer-term development objectives of the beneficiary countries and must respect fundamental humanitarian principles. Members shall ensure that the food assistance provided reaches the intended recipients on time.
e) To the greatest extent possible, non-emergency food assistance will be provided by members on the basis of Advance planning so that recipient countries can take into account, in their development programs, food aid that they can expect to receive each year of this Convention.
f) It turns out that due to a marked deficit in production or any other difficulty, a given country, or even one or more regions, are faced with critical food needs, the situation will be reviewed by the Committee. Article IX
Forms and Conditions of Aid


a) Help Under this Convention may be provided in one of the following ways:
i) Gifts of food products or cash donations for use in the purchase of food products for or by the recipient country;
(ii) Sales of food products against the recipient country's currency, which is not transferable or convertible into foreign currency or goods and services that may be used by the donor member;
(iii) Sales of food products to Credit, the payment to be made by reasonable annuities over twenty years or more, at a rate of interest lower than the commercial rates in force on world markets.
(b) With regard to food aid only With respect to a member's commitment, all food assistance provided to the least developed countries will be provided in the form of donations.
(c) Food aid provided under this Convention in the form of donations shall not represent Less than 80 % of a member's contribution and, to the extent possible, members will endeavour to progressively exceed this percentage.
d) Members undertake to carry out all their food aid operations under the This Convention shall be so as to avoid prejudice to the normal structure of production and international trade.
e) Members shall ensure that:
i) The granting of food aid shall not be directly or indirectly linked, Formally or informally, in an express or tacit manner, to commercial exports of agricultural products or other goods and services to the recipient countries;

Article X
Transport and delivery

Article XI
Distribution


a) Members can provide food aid bilaterally or through intergovernmental organizations or others International or non-governmental organizations.

Article XII
Local purchases and triangular transactions


a) In order to promote local agricultural development, strengthen regional and local markets, and enhance the longer-term food security of recipient countries, members must consider the possibility of: Devote or direct their cash contributions to the purchase of food products:
i) For the recipient country's approach to other developing countries ("triangular transactions") ; or
(ii) In a region of a developing country for the purpose of supplying another deficit region of the country in question ("local purchases").
(b) Cash contributions will not, in principle, be used to purchase a food product from a country that is of the same type as the country that supplied the supply as a bilateral food aid or In the same year, or in previous years if the amount of food aid received is not yet exhausted.

Article XIII
Efficiency and Impact

ii) Respect local eating habits and nutritional needs of beneficiaries and minimize any possible negative effects on their diets; and

Article XIV
Information and Coordination


a) Members shall submit periodic reports to the Committee on the amount, composition, distribution arrangements, costs including transport and other operational costs, form The conditions of their contributions in accordance with the provisions of the rules of procedure.
(b) The members undertake to provide the statistical data and other information necessary for the proper functioning of this Convention, in particular With respect to:
i) Their shipments of assistance, including purchases of products made through cash contributions, local purchases or triangular transactions, and those delivered through international organizations ;
ii) The agreements they have entered into for the future supply of food aid;
iii) Their policies for the provision and distribution of food aid. To the extent possible, such notifications shall be made in writing to the Executive Director before each ordinary session of the Committee.
(c) Members making contributions under this Convention in the form of Multilateral cash contribution to international organisations must notify the fulfilment of their obligations in accordance with the rules of procedure.
d) Members shall exchange information on their policies and Food aid programmes and the results of their evaluations of these policies and programmes and strive to ensure the compatibility of their food aid programmes with food security strategies on a scale National, regional, local and household level.
(e) Members shall indicate to the Committee in advance the amount of their commitment not made in the form of donations and the terms and conditions of any assistance that is not provided in this form.


Third Part
ADMINISTRATION
Article XV
Food Aid Committee


a) The Food Aid Committee, established by the Convention on Food Aid of the International Agreement On the cereals of 1967, shall continue to exist in order to administer this Convention; it shall retain the powers and functions assigned to it under this Convention.
(b) The Committee shall be composed of all Parties to the present
c) Each member of the Committee shall appoint a representative residing at the headquarters of the Committee to whom the notifications of the secretariat and other communications relating to the work of the Committee shall normally be addressed. Other provisions may be made by any member of the Committee in agreement with the Executive Director.


Article XVI
Powers and functions


a) The Committee takes the decisions and exercises the Functions necessary for the application of the provisions of this Convention. It shall adopt the rules necessary for this purpose in the rules of procedure.
(b) Decisions of the Committee shall be taken by consensus.
(c) The Committee shall monitor the food aid needs of developing countries and the capacity of the

Article XVII
Chair and Vice-Chair


a) During the last regulatory session of each year, the Committee Nominates a Chair and Vice-Chair for the following year.

i) Approves the draft agenda for each session;
ii) Provides for sessions;
iii) Provides for the opening and closing of each meeting; and Each session;
(iv) Submits, at the beginning of each session, the draft agenda for approval by the Committee;
v) Directs the debates and ensures the application of the rules of procedure;
(vi) Gives the floor and decides on any motion Order in accordance with the rules of procedure;
(vii) Submits the questions to the Committee's decision and announces the decisions; and
(viii) Statues on any motion submitted by the delegates.
(c) If the President is obliged to be absent A session, or part of a session, or if it is temporarily prevented from carrying out the functions of the President, the Vice-President shall replace it. In the absence of the President and the Vice-President, the Committee shall appoint a temporary President.
(d) If, for any reason, the President cannot continue to carry out his duties, he shall be replaced by the Vice-President pending the Committee 's Appoint a new President.

Article XVIII
Sessions


a) The Committee shall meet at least twice a year at the statutory sessions of the International Grains Council. The Committee shall also meet at any other time on the decision of the President, at the request of three members, or where the provisions of this Convention so require.

Article XIX
Secretariat

(b) The Executive Director shall apply the directives of the Committee and shall carry out the functions stipulated by the This Convention and its Rules of Procedure.


Article XX
Landings and Disputes


(a) In the event of a dispute relating to the interpretation or application of this Convention or Failure to fulfil obligations under this Convention, the Committee meets to decide what action to take.
b) Members agree to take into account the recommendations and conclusions reached by the Committee by consensus In the event of disagreement concerning the application of the provisions of this Convention.


Fourth Part
FINAL PROVISIONS
Article XXI
Depositary


The Secretary-General of the Nations United Nations shall be designated as the depositary of this Convention.


Article XXII
Signature and ratification


(a) This Convention shall be open from 1 May 1999 to 30 June 1999 inclusive of signature The governments referred to in paragraph e of Article III.
(b) This Convention shall be subject to ratification, acceptance or approval by each signatory government in accordance with its constitutional procedures. Instruments of ratification, acceptance or approval shall be deposited with the depositary by 30 June 1999 at the latest, on the understanding that the Committee may grant one or more extensions of time to any signatory government that Have not deposited its instrument of ratification, acceptance or approval at that date.
(c) Any signatory government may file with the depositary a declaration of provisional application of this Convention. It shall apply this Convention provisionally in accordance with its laws and regulations and shall be deemed provisionally to be a Party.
(d) The depositary shall notify all signatory and acceding Governments of any signature, ratification, acceptance, Approval, provisional application of this Convention and any accession to this Convention.


Article XXIII
Accession


a) This Convention is open to the accession of all Government referred to in paragraph e of Article III which has not signed this Convention. The instruments of accession shall be deposited with the depositary by 30 June 1999 at the latest, on the understanding that the Committee may grant one or more extensions of time to any Government which has not deposited its instrument at that date
(b) When this Convention enters into force in accordance with the provisions of Article XXIV, it shall be open for accession by any Government other than those referred to in article III, paragraph (e), on the terms and conditions of the Committee Deems appropriate. Instruments of accession shall be deposited with the depositary.
(c) Any Government acceding to this Convention under this Article or whose accession has been approved by the Committee under paragraph (b) of this Article shall be deposited with the depositary. Article may file with the depositary a declaration of provisional application of this Convention pending the deposit of its instrument of accession. Such Government shall apply this Convention provisionally in accordance with the laws and regulations and shall be deemed to be provisionally Part.


Article XXIV
Entry into Force


a) The present The Convention will enter into force on 1 July 1999 if, as at 30 June 1999, Governments, whose cumulative commitments, as referred to in article III, paragraph e, represent at least 75 per cent of the total commitments of all Governments Referred to in that paragraph, have deposited instruments of ratification, acceptance, approval or accession, or declarations of provisional application, and provided that the 1995 Convention on Trade in Cereals is in force
(b) If this Convention does not enter into force in accordance with the provisions of paragraph a of this Article, governments, who have deposited instruments of ratification, acceptance, approval or accession, or Declarations of provisional application, may decide unanimously that it will enter into force between themselves, provided that the 1995 Cereal Trade Convention is in force.


Article XXV
Duration Withdrawal


(a) Unless it is continued in accordance with paragraph b of this article or has been terminated in accordance with paragraph f of this article, this Convention shall remain in force Until 30 June 2002, subject to the provisions of the 1995 Convention on Trade in Cereals, or a new Convention on the Trade of Cereal Grains, which shall remain in force until that
. Convention beyond 30 June 2002 for successive periods not exceeding two years each, provided that the 1995 Convention on Trade in Cereals, or a new Convention on the Trade of Cereal Grains, remains In force for the duration of the extension.
(c) If this Convention is continued under paragraph (b) of this Article, the commitments of members under Article III (e) may be subject to review by the Members prior to the coming into force of each extension. Individual commitments, as reviewed, will remain unchanged for the duration of each extension.
d) The operation of this Convention will be monitored, in particular with regard to the results of all Multilateral negotiations affecting the provision of food aid, in particular to preferential credit conditions, and the need to apply the results.
e) The situation with regard to all aid operations And, in particular, those carried out under preferential credit conditions, shall be reviewed before deciding on any extension of this Convention or any new convention.
(f) If this is terminated Convention, the Committee shall continue to exist as long as it is necessary to proceed with its liquidation and shall have the powers and perform the functions necessary for that
. Of any year by notifying the depositary in writing at least ninety days before the end of the year in question, but it is thus not relieved of any obligations arising out of this Convention and not carried out before the end of that year. Article XXVI
Agreement International Grains Convention


This Convention replaces the 1995 Food Aid Convention, as extended, and is one of the constituent instruments of the International Agreement on Food 1995 cereals.

TRANSPORTATION COSTS AND OTHER OPERATIONAL COSTS


Transportation costs and other operational costs associated with food aid contributions that are included in the terms Articles II a (XX), III, X and XIV of this Convention are as follows:
a) Transport costs:
Freight, including loading and unloading;
Suressea and shipping;
Transborder;
sachage;
Insurance And supervision;
Port fees and storage taxes at port;
Temporary storage facilities and port and transit taxes;
Road transport, vehicle rental, toll and escort charges, convoy and border taxes ;
Equipment rental;
Airplane, airlift.
b) Other operational costs:
Non-food items (ENA) used by beneficiaries (tools, utensils, agricultural inputs);
ENA provided to implementing partners (vehicles, storage facilities);
Training costs for local partners;
Operating costs incurred by local partners in the implementation of operations, not covered as transportation costs;
Milling and other special costs;
NGO costs in the recipient country;
Technical support services and logistics management;
Project preparation, feasibility study, monitoring and evaluation;
Recipient registration ;
Technical Services in the recipient country.

Eligible food aid recipients under Article VII of this Convention are: Developing countries and territories listed as aid recipients by the OECD Development Assistance Committee (DAC), as of 1 January 1997, and listed below, as well as countries on the WTO list of countries in Net Food Importers, as of March 1, 1999.
a) Least Developed Countries:
