Abstract

Partial transposition of Council of the European Union Directive 99 /13/EC of 11 March 1999 on the reduction of emissions of organic compounds due to the use of volatile organic solvents in certain activities and Facilities. Implementation of the 1979 Convention on Long-range Transboundary Air Pollution and its protocols, including the 1991 Geneva Convention on the reduction of VOC emissions and their transboundary fluxes. Application of the Directive on dangerous preparations 88 /379/EEC. Application of Decree No. 77-1133 of 21 September 1977, adopted for the purposes of Act No. 76-663 of 19 July 1976 on installations classified for the protection of the environment; Decree No. 88-1231 of 29 December 1988 relating to Dangerous substances and preparations; of the decree of 20 April 1994 on the declaration, classification and labelling of substances. Application of the notices of the Board of Facilities, dated March 15, 2001 and December 18, 2001. This Order amends the Decision of 2 February 1998 as amended relating to the taking and consumption of water and to emissions of all kinds of installations classified for the protection of the environment subject to authorisation, and in particular Articles 21, 27, 30, 59 and 70.

" 36 ° Surface Cleanup


(Any cleaning or degreasing of surfaces using organohalogenated liquids or organic solvents. A cleaning activity consisting of several steps occurring before and after another activity is considered to be a single activity.)
If solvent consumption is greater than 2 tonnes per year, the provisions of the first paragraph of the A of 7 ° of Article 27 shall be replaced by the following provisions:
" The limit value expressed in total carbon of the overall concentration of all volatile organic compounds excluding methane is 75 mg/m³. The annual flux of diffuse emissions of these compounds shall not exceed 20 % of the quantity of solvents used; this rate shall be reduced to 15 % if the consumption of solvents is greater than 10 tonnes per year.

If consumption of Risk phrase solvents R 45, R 46, R 49, R 60, R 61 or halogenated residues R 40 is greater than 1 tonne per year, the provisions of the second subparagraph of Article 27 (c) of Article 27 are replaced by the following provisions:
The limit value of the overall concentration of the risk phrase solvents R 45, R 46, R 49, R 60, R 61, expressed as the mass of the sum of the various compounds, is 2 mg/m³. The limit value of the global concentration of halogenated solvents labelled R 40, expressed as a mass of the sum of the different compounds, is 20 mg/m³. The annual flux of the diffuse emissions of these solvents should not exceed 15 % of the quantity of solvents used; this rate is reduced to 10 % if the consumption of solvents is greater than 5 tonnes per year. "

I. -The V of Article 70 of the Order of 2 February 1998 reads as follows: '
' V.-The provisions of 8 ° of Article 27 relating to discharges of metals shall apply to existing installations as from 1 January 2003.
The provisions relating to the monitoring of discharges set out in Article 59 (8) and Section 63 applies to existing facilities as of January 1, 2001. "
II. -In Article 70 of the abovementioned decree of 2 February 1998, it is added a VII worded as follows: '
' VII. -The provisions relating to the release of VOCs from 7 ° of Article 27, Article 28-1, 19 ° to 36 ° of Article 30 and 7 ° of Article 59 shall apply:
-to installations authorised before 31 December 2000, as soon as they are put into service, and ;
-facilities authorized prior to January 1, 2001, as of October 30, 2005 unless otherwise specified in a and b below.
(a) Facilities authorized prior to January 1, 2001 and equipped with processing equipment VOC emissions, prior to the issuance of this Order, and that meet the following emission values:
-in the case of oxidation, 50 mg/m³ for total carbon VOCs and limit values for NOx, CO and methane Under Article 27 (7) of this Order, multiplied by a coefficiency1.5;
-for other processing equipment, 150 mg/m³ for total carbon VOCs,
has until January 1, 2012, a derogation from The application of the VOC emission limit values provided for in Article 27 (7), provided that the total flow of emissions from the facility as a whole does not exceed the level that would have been achieved if all the requirements contained in Section 30 was complied with.
(b) For an authorized installation prior to January 1, 2001, and on which a master plan for VOC emissions is implemented as defined in section 27 of section 27, but which is confronted with Technical-economic problems, the prefect may grant a postponement of the deadline for the compliance of the installation, within the limit of 30 October 2007 and on the basis:
-of a business case filed by the operator before 1 January 2004, And;
-a notice from the Board of Governors of facilities classified for the protection of the environment. "
