On the report of the Overseas Minister,
Given the Constitution, including Articles 21, 73 and 74;
Given the Labour Code;
Given the Labour Code applicable to Mayotte;
Vu Decree No. 2006-672 of 8 June 2006 on the creation, composition and operation of administrative committees of an advisory nature;
Given the referral to the General Council of Guadeloupe on 12 February 2007;
Seen Referral to the General Council of French Guiana as of 22 February 2007;
In view of the opinion of the General Council of Martinique of 22 March 2007;
In view of the opinion of the General Council of Réunion as of 21 February 2007;
In view of the reference to the Council Regional of Guadeloupe as of February 12, 2007;
Seeing the Referral to the Regional Council of Guyana as of February 8, 2007;
Seeing the Referral to the Regional Council of Martinique as of February 13, 2007;
In view of the opinion of the Regional Council De La Réunion as of February 13, 2007;
In view of the opinion of the General Council of Mayotte dated March 14, 2007;
Seeing the reference to the General Council of Saint-Pierre-et-Miquelon as of February 7, 2007,
Décrète:

Item 1
It is created in Guadeloupe, French Guiana, Martinique, Réunion, Mayotte and Saint-Pierre-et-Miquelon an observatory of prices and incomes whose mission is to analyse the level and structure of prices And provide public authorities with regular information on their evolution.

Each price and revenue observatory can issue opinions to inform public authorities about the conduct of economic policy and social cohesion.
It prepares an annual report, which can Be accompanied by opinions and proposals. The report shall be addressed to the Minister for Overseas Affairs, the Minister for Economic Affairs and Finance and the Minister for Employment. It is made public.
It may also, at the request of its President or a third of its members, make special reports.

Each price and revenue observatory includes the following members:
1 In the overseas departments and regions:
a) The representative of the State in the overseas department and region, Chair;
b) Parliamentarians elected within the jurisdiction of each department and region;
c) The Chair of the Regional Council;
d) The Chair of the General Council;
e) A mayor proposed by the President of the Association of Mayors;
(f) The President of the Regional Economic and Social Council;
(g) Four representatives of the State:
-the Regional Paymaster-Paymaster;
-the Regional or Interregional Director of the National Institute of Statistics and Studies Economic;
-the Regional or Departmental Director of Competition, Consumer Affairs and Fraud Prevention;
-the Director of Labour, Employment and Professional Training;
h) Three representatives of the Chambers Consular:
-the President of the Chamber of Commerce and Industry;
-the President of the Chamber of Commerce;
-the President of the Chamber of Agriculture;
i) Three representatives of trade unions of employees in the sector The private sector and the public sector designated in accordance with Article R. 852-2 of the Labour Code;
(j) Three qualified persons due to their competence or knowledge of price and income training;
(k) The Regional Director of the Institute for the Issuing of Overseas Departments;
2 ° A Mayotte:
a) The State Representative in Mayotte, President;
b) Elected parliamentarians in Mayotte;
c) The President of the General Council;
d) One Mayor proposed by the president of the association of mayors;
e) President of the economic and social council of Mayotte;
f) Three representatives of the state:
-the general paymaster;
-the local representative of the National Institute Statistics and economic studies;
-the Director of Employment and Vocational Training;
(g) Three representatives of the consular chambers:
-the President of the Chamber of Commerce and Industry;
-the President of the Professional Chamber of Trades;
-the President of the Chamber of Agriculture, Fisheries and Aquaculture;
h) Three representatives of the trade unions of employees in the private and designated public sector According to the procedure laid down in Article L. 412-3 of the Labour Code applicable to Mayotte;
i) Three qualified persons because of their competence or knowledge of price and income training;
j) The Director Local of the Institut d' emission des départements d' Overseas;
3 ° A Saint-Pierre-et-Miquelon:
a) The representative of the State in Saint-Pierre-et-Miquelon, President;
b) The parliamentarians elected in Saint-Pierre-et-Miquelon;
c) The President Territorial Council;
d) The mayors of the communes of the archipelago;
e) The President of the Economic, Social and Cultural Council;
f) Three representatives of the state:
-the general paymaster;
-the head of the service of the Competition, consumption and enforcement of fraud;
-the departmental director of labour, employment and vocational training;
g) The President of the Chamber of Commerce and Industry and Trades;
(h) Two Representatives of the trade unions of employees in the private sector and the public sector designated in accordance with Article R. 852-2 of the Labour Code;
(i) Two persons qualified as a result of their competence or Knowledge of price and income training;
j) The local director of the Institute for the issuance of the overseas departments.
The mayors referred to in the 1st and 2nd of the 2 °, the representatives of the trade unions referred to in the 1 ° and at the h of 2 ° and 3 ° and the qualified persons referred to in the j of 1 ° and the i of 2 ° and 3 ° shall be designated by order of the representative of the State for a renewable period of three years.
The President and members of each observatory which A member of the service or organization to which they belong may serve because of their duties.
A member appointed on the basis of his or her elected office may be replaced by an elected member of the same Legislative Assembly.
The alternates of qualified persons shall be appointed under the same conditions as these.

The members of each observatory are obliged to have a duty of secrecy with regard to information of a confidential nature which they are aware of in the course of the exercise of their Missions.

Each price and revenue observatory meets at least once a year. It shall also meet at the request of at least one third of its members. It may constitute specialised committees. It decides on its work programme.

Unless otherwise provided by legislation, state administrations and state institutions are obliged to communicate to their request the information and studies available to them. Which appear necessary to the observatories for the performance of their mission. The observatories shall inform the administrations of the State of their needs in order to take them into account in the preparation of their statistical and study programmes.
