Vu The opinion of the Board of Directors of the National Pension Fund for Employed Workers as of 17 January 2007;
The Conseil d' Etat (social section) heard,
Decorated:
I. -Article R. 351-6 of the Social Security Code is amended as follows:
-in the last paragraph of the I, the words: Pensions taking effect after 31 December 2007 and " Are deleted;
-in the first paragraph of II, the words: " And before January 1, 2008 " Are deleted.
II. -Article R. 351-29-1 of the Social Security Code is amended as follows:
-to I, the words: Pensions taking effect after 31 December 2007, regardless of the date of birth of the insured person " Are replaced by the words: " Insured persons born after 1947, regardless of the effective date of their pension " ;
-in the first paragraph of II, the words: " With regard to pensions having effect before 1 January 2008 " Are deleted;
-the last paragraph of II and III are deleted.
III. -The second paragraph of Article R. 353-3 of the Social Security Code is deleted.
I. -Article R. 634-1-1 of the Social Security Code is amended as follows:
-to I, the words: Pensions taking effect after 31 December 2012, regardless of the date of birth of the insured person " Are replaced by the words: " Insured persons born after 1952, regardless of the effective date of their pension " ;
-in the first paragraph of II, the words: " With regard to pensions having effect before 1 January 2013 " Are deleted;
-the last paragraph of II and III are deleted.
II. -The second paragraph of Article R. 634-5 of the Social Security Code is deleted.
Article R. 753-24-1 of the Social Security Code is amended as follows:
-in I, the words: " Pensions taking effect after 31 December 2007, regardless of the date of birth of the insured person " Are replaced by the words: " Insured persons born after 1947, regardless of the effective date of their pension " ;
-in the first paragraph of II, the words: " With regard to pensions having effect before 1 January 2008 " Are deleted;
-the III is deleted.
The Minister for Agriculture and Fisheries and the Minister for Health and Solidarity shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic.
