Order of April 10, 2002 extending d 'an endorsement to an agreement entered into under the collective agreement of the national collective agreement of the trade#039industry; the soil products industry, fertilizers and Related products

La Minister for Employment and Solidarity,
In view of Articles L. 133-1 et seq. Of the Labour Code;
Having regard to the Order of 13 August 1981 and the successive orders, in particular the Order of 10 May 2001, extending the national collective agreement Of the trading companies and the soil products industry, fertilisers and related products of 2 July 1980 and of the texts which have amended or supplemented it;
Having regard to the amendment of 11 July 2001 to the agreement of 29 July 1998 on development and to Reduction of working hours under the above collective agreement;
Given the request for extension by the signatory organizations;
In view of the opinion published in the Official Journal of 11 December 2001;
In view of the opinions Collected during the course of the investigation;
Due to the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements) rendered in session on March 28, 2002,
Stop:

Article 1


Are made mandatory for all employers and employees included in the scope of the national collective agreement On 2 July 1980, as supplemented by Amendment No 24 of 23 May 1989, the provisions of the amendment of 11 July 2001 to the Agreement of 29 July 1998 on The development and reduction of working time concluded within the framework of the aforementioned collective agreement, excluding the second sentence of the eighth paragraph of Article 8 as contrary to Article L. 212-8 of the Labour
. The first indent of the third subparagraph of the second paragraph shall be extended subject to the intervention of an enterprise agreement, in accordance with the provisions of the ninth paragraph of Article L. 212-8 of the Labour
. Sixth paragraph of Article 8 shall be extended subject to the application of Articles L. 145-2 and R. 145-2 of the Labour Code.

Article 2


The extension of the effects and sanctions of the endorsement referred to above shall be made from the date of publication of this Order for the remainder of the term and the conditions laid down by the said rider.

Article 3


The Director of Labour Relations is responsible for the execution of this Order, which will be published in the Official Journal of the French Republic.
