Having regard to Decree No. 71-345 of 5 May 1971 concerning the Special status of the body of public works engineers of the state (service of equipment);
In light of Decree No. 88-399 of 21 April 1988 on the special status of the body of public works inspectors of the State;
Seen the Decree No. 94-1016 of 18 November 1994 laying down the common statutory provisions applicable to various bodies of officials of category B, as amended by Decree No. 97-301 of 3 April 1997 and by Decree No. 2001-1238 of 19 December 2001;
Vu The opinion of the Joint Ministerial Technical Committee of 18 December 2002;
The Council of State (Finance Section) Heard:
Article 2 of the decree of 21 April 1988 is replaced by the following:
" Art. 2. -The body of public works controllers in the state has three grades:
" The rank of public works supervisor in the 13 echelons;
" The rank of chief controller of public works in the state that has 8 levels;
" The rank of the divisional controller of public works in the state, which comprises 8 levels.
" Public servants in this body are divided into the following domains:
" 1 ° Land development and infrastructure;
" 2 ° River, sea or port layout and infrastructure;
" 3 ° Phares and beacons and maritime safety. "
Section 3 of the Order is replaced by the following:
" Art. 3. -The controllers of the three ranks shall be responsible for the management and operation of the transport infrastructure, the organisation and control of new or maintenance work carried out by a company or in governance, consultancy and assistance To mastership.
" They are involved in the implementation of state policies and in monitoring compliance with regulations such as town planning, construction, environment and the public

Section 4 of the Order is replaced by the following:
" Art. 4. -Senior and divisional controllers may be responsible for the preparation, organisation of the checks and the conduct of major sites or requiring a specific technicality.

" Senior and divisional controllers are involved in the management of these structures and can provide leadership. Divisional controllers can provide direction for important structures. "
After Article 4 of the same decree, an article 4-1 reads as follows:
" Article 4-1. -Supervisors of public works of the State may, during their careers, apply to perform duties corresponding to a job in another field. Stakeholders are called as a need to take training actions. "
In Articles 5 and 6 of the same decree, the words:" The chief controllers and controllers of public works of the state " Are replaced by the words: " Members of the body of public works inspectors of the state ".
The last sentence of Article 6 of the same decree Is repealed.
Section 7 of the Order is amended as follows:
I.-In the first paragraph, the words " Each of the defined specialties " Are replaced by the words: " Each of the defined domains " ;
II. -At the b of 1 °, the proportion of " 40 % " Is replaced by the proportion of " 25 % " And the words: " Aged forty-five years to the first of January of the year of the competition and having at the same date four years of public service " Are replaced by the words: " Four years of public services on January 1 of the year of the competition " ;
III. -The 2 ° is replaced by the following:

Section 14 of the Order is replaced by the The following provisions:
" Art. 14. -The average duration and minimum duration of time spent at each level of the grades referred to in Article 2 shall be those laid down in Article 10 of the Decree of 18 November 1994. "

In Title III of the same decree, after Article 15, an article 15-1 reads as follows:

" Appointments to the rank of divisional controller of public works of the State shall be made by order of the minister responsible for the equipment. "
Articles 15 bis, 15 ter and 20 bis respectively become Articles 15 -2, 15-3 and 20-1.
Section 6 I, 2 The decree of 5 May 1971 is replaced by the following provisions:
" 2 ° For one fifth of the number of jobs to be filled, among the senior technicians of the equipment and public works supervisors of the state who have met a professional examination and who have carried out a training course or among others The members of the body of the senior technicians of the equipment, who have been placed on a list of fitness established under the conditions of Article 15. "
In the first paragraph of Article 13 of the Decree, the reference to" Article 6-I above " Is replaced by a reference to " I of Article 6 " And the words: " And justify to that same date of eight years of effective services in this capacity " Are replaced by the words: " And justify to that same date, in the position of activity or secondment, eight years of effective service in that capacity, of which six years in a service or public establishment of the State ".

Article 14 of the same Decree shall be replaced by the following provisions :
" Art. 14. -The engineers of the public works of the State recruited by the professional examination provided for in 2 ° of the I of Article 6 shall be established under the conditions laid down in Article 15-3 for the higher technicians of the equipment and 15-4 for the Public works controllers of the state.
For a period of three years from the date Of the publication of this Decree, members of the body of public works drivers of the State governed by Decree No. 66-900 of 18 November 1966 on the special status of the body of public works drivers of the State may be appointed In the body of public works inspectors of the State under the conditions laid down in Article 7 of the Decree of 21 April 1988 referred to above.
The Minister of Economy, Finance and Industry, the Minister of Equipment, Transportation, Housing, Tourism and the Sea, the Minister of the Public Service, State Reform and Planning Territory and the Minister responsible for the budget and budgetary reform shall each have responsibility for the implementation of this Decree, which shall be published in the Official Journal of the French Republic
