Decree of 1 April 2005 extending d ' an interdepartmental agreement (Loire-Atlantique, Maine-et-Loire, Mayenne, Sarthe, Vendée) entered into under the national collective agreements concerning the Workers employed by construction companies (companies occupying up to#039employees and more than 10 employees) (n ° 1596 and n ° 1597)

The Minister of Employment, Labour and Social Cohesion and the Minister for Agriculture, Food, Fisheries and Rurality,
In accordance with Articles L. 133-1 et seq. Of the Labour Code;
In the light of the orders of 12 February 1991 and 15 December 1992 extending the national collective agreement of 8 October 1990 concerning the workers employed by the Undertakings of the building covered by the decree of 1 March 1962 (i.e. occupying up to ten employees) and endorsements supplementing it;
Having regard to the Order of 8 February 1991 extending the national collective agreement of 8 October 1990 Concerning the workers employed by the construction companies not covered by the decree of 1 March 1962 (i.e. occupying more than 10 employees);
In view of the decree of 18 May 2004 extending two inter-departmental agreements (Loire-Atlantique, Maine-et-Loire, Mayenne, Sarthe, Vendée) concluded within the framework of the abovementioned collective agreements;
Given the interdepartmental agreement (Loire-Atlantique, Maine-et-Loire, Mayenne, Sarthe, Vendée) of 14 September 2004 concerning Minimum wages entered under the collective agreements referred to above;
Given the request for extension by the signatory organisations;
In view of the opinions published in the Official Journal of 12 January 2005 and 25 February 2005;
Seen Advice gathered during the investigation;
Given the reasoned opinion of the National Commission for Collective Bargaining (Sub-Committee on Conventions and Agreements), collected in accordance with the procedure laid down in Article R. 133-2 of the Labour Code,

Item 1


Are made mandatory for all employers and employees included in the field Professional application of the national collective agreement of 8 October 1990 concerning workers employed by undertakings in the building referred to in the decree of 1 March 1962 (i.e. occupying up to ten employees), as supplemented by Amendment No 1 of 17 March 1992, and in that of the national collective agreement of 8 October 1990 concerning workers employed by undertakings in the building not covered by the decree of 1 March 1962 (i.e. occupying more than ten employees), As extended by order of 8 February 1991 and in its own territorial scope, the provisions of the interdepartmental agreement (Loire-Atlantique, Maine-et-Loire, Mayenne, Sarthe, Vendée) of 14 September 2004 on minimum wages Pursuant to the aforementioned collective agreements, subject to the application of the provisions of Article 32 of the amended Act No. 2000-37 of 19 January 2000 introducing a monthly guarantee of remuneration.

Article 2


The extension of the effects and sanctions of the aforementioned agreement shall be made from the date of publication of this Order for the remainder of the period to be Conditions provided for by the said agreement.

Article 3


The Director of Labour Relations at the Ministry of Labour, Labour and Social cohesion and the Director-General of the Forest and Rural Affairs in the Ministry of Agriculture, Food, Fisheries and Rural Affairs shall each have responsibility for the execution of this Order, which shall be published in the Official Journal of the French Republic.
